AOS from K1 Affidavit & address question

Hi, I am sorry if this is not in the correct place but can anyone help me with the following question?

 

I am from the UK and my fiance is from the USA, we have gone through the K1 process and now I am living in the USA, we get married this Friday.

 

We are going to apply for the AOS soon after the marriage and well before the 90 days is up of the K1 which is the 20th April.

My fiance sponsored me for the K1 but situations have changed since then and now we are wanting to carry on the AOS with my fiance's mother sponsoring me. She meets the earning requirements and she is willing to do it as she has more job security... I am wondering if we need to do anything in particular to change who is sponsoring me or if we just send the AOS with the I-864 from her mother instead of herself?

Also do they need the form from both of them or just her mother?

 

Also my apologies but I have another question. When I moved to the USA my Fiance got an apartment of her own and I am not too sure if we have to notify them somewhere of the address change or if we just put the new address on the AOS application.

 

If anyone can advise on this that would be great.

 

If this is in the incorrect place and you have the ability to move it please can you do so.

Both your wife and her mother need to fill out an i864 for you. Your wife will always be your primary sponsor, even without the needed financials. You don't need to notify them in any other way of the sponsor change.

 

You'll also let them know of the address change when you submit the AOS, that's perfectly fine.

If it isn't difficult, it isn't worth it.

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

So my fiance will need to fill out the affidavit and she will only have two tax returns which will no show enough income and possibly no income at all when we apply for the AOS. Do we need to write anywhere that we will be using savings to fund our living costs and her mothers income as the sponsor? 

 

Sorry I know it probably sounds like a daft question but I just want to know exactly what we are doing before we apply. Don't want to get anything wrong.

You don't have to show anything other than them together meeting the requirement. Don't forget the supporting documents :) How you solve your everyday financials isn't relevant to them :) Welcome Zoe! and have a wonderful wedding day!

No, you don't have to do that. I suppose you both will be working soon enough, and the CO will trust that your wife's mother will support you (if necessary) in the mean time.

If it isn't difficult, it isn't worth it.

Timeline

about the address part, if you guys send the AOS paperwork with the new address as current, that's good. From then on, whoever moves again (you, your spouse or your joint sponsor) will have to notify the address change to USCIS.
