On December 27, my wife (from Brazil) and I (USC) filed forms I-485, I-765, I-131, and I-130 along with all supporting forms and documentation. We submitted checks for $1,225 and $535 for the I-485+Biometrics and I-130, respectively.

Our rejection notices stated that we submitted incorrect fees, but all research done and conversations with USCIS indicate that we did everything correctly. The I-485 and I-131 were also rejected for being on outdated versions of the forms, but all research and conversations with the USCIS indicate that the form we sent was current at the time of sending and acceptable until 2/21/17. Rev date of 12/23/16 for both forms filed. 

 

To resubmit, what do we need to do? Should I separate the I-485 and biometrics fee? Can I pay with a personal check? Should I print out new forms and re-organize all supporting documentation or send everything back with a cover letter and new checks/new forms for the ones they said were out of date? Are the original personal checks acceptable with an explanation of the situation?

Hi!

We resent the entire package as they sent it back to us with a cover letter explaining the situation and duplicates of the forms we sent with the now upgraded forms and copies of the checks in the same amount as before. They have received the package, but we will not know the status for another week or so. 

I'm not sure if we did the right thing, but I really hope so.
