petitioning a family member

Hi Guys,

 

Just curious, my friend is thinking of petitioning her mother, who has been staying here for 4 months. her stay will expire on march 19 2017.  Will she be considered as over staying if the process time of her petition goes beyond march 19 2017.. Also which forms will they have to fill out.

As long as they receive the receipt notice that the petition was received for processing she should be fine. She will be in a kind of limbo legal status during the processing and after the expiration of her visa.

 

But as above, this all depends if the petitioner is a USC or not....

what if she's a US citizen? how long you think that you receive the receipt?  thanks
