If the fiance overstayed and did not leave then they are here Illegally. That is a concern for the Navy because you might have a clearance so if you are living with someone who is illegal then it could harm your clearance status. If you get married then file for AOS asap but expect the AOS to be scrutinized.

Why would it be scrutinized?

You mean get married, and apply the regular way , petition for alien relative?

Because if that individual has a security clearance then he could come under investigation and possibly lose his security clearance. This is because having a clearance and being involved with people that here Illegally is a grave concern in regards to military secrets. That person in the eyes of the government could use the sailor to get information from him and give to a 3rd party, and yes it has happened in the past. When you go for a Clearance investigation you have to actually list who you talk to overseas and your relationships with them. When I went for my Top Secret investigation a couple months ago I let them know that yes I have a Philippine National who is a PR as a wife, and we do still keep in contact with her family. They then asked me if she will file for citizenship later and I said "Yes" and that was that. But you can not lie because they do a polygraph on you and if you fail then you can and will lose the job/clearance.

They would have to get married, and file the AOS the regular way. Since she is here already then their AOS could be scrutinized even more because USCIS may think that they only got married so that she does not get deported and it could be a sham marriage.

Wasn't there a directive passed a couple of years back insuring the safety of undocumented spouses of military members?

What I am talking about has no affect on Illegal spouses of a military member. What it concerns about is the Military member themselves because it could affect National Security and it harm someone's clearance status.
