We make an signed if explanation letter and we attach also the 1040A and also the receipt that we send it already to h&r block to texas austin.we still waiting for their email if they want more document :/

That what i did my husband made an exanation letter and attach it with the 1040a and also we attach the receipt of 2go proof that we send it already to texas  his taxes. 2015. Im just worried about the domicile that i hope they still consider it.

You can also file an IRS form 4056 asking for proof of non filing for the years they are requesting. If you fax the form they will respond in about 3-5 days. You must also include a notarized letter stating why did he not file for 2 years. What that means is a sworn statement that in the last two years he did not receive any income from work. Also if you sent 1040a did you include the W2s? Since you filed in 2016, they are looking for verification of your 2015 taxes as 2016 taxes are not yet due. Or at least that is how it reads to me. A tax document does not state whether or not a person works, it just says that the person did or did not file taxes. In most cases a state ID with a current address is acceptable proof of current address especially if it the one you used for all of your forms. Best of Luck.

I have similar concerns on the domicile for myself. When I was asked on another part of the forum the following was suggested:

 

1) Lease. Even if it's with sister or other family member have a lease or agreement signed that you will be staying with them.

2) Bank accounts - did your fiancé keep a usa bank account. If so then send this with USA address.

3) Credit cards - any American credit cards with USA address

4) Storage - your items in storage in America showing you are coming back.

5) Drivers License

Thank u for  the information.They asking for domicile also and i just send my husband driver licence id .yes i will let u guys know when my status change to issued.i hope they gonna approve it so soon.
