My son's girlfriend is holding a student visa right now. She is currently enrolled in school and will stay here for 2 yrs. They are planning to get  married this summer of July. Can she apply for her Greencard after their marriage or does she has to wait till she finish her 2 yrs as student visa? Can she stay here in US after their marriage or does she needs to go home to Philippines? By the way, my son is a US citizen. 

Appreciate your thoughts and advices!

Your son can marry the girlfriend anytime. Then, file I-130 & I-485.

I-130

08/20/2015: I-130 package sent  (Priority Date)

12/30/2015: 1-130 Approved

 

06/01/2016: Welcome Letter

 

I-485/I-765/I-131

10/28/2016: AOS Application Package Sent to Chicago (UPS)
10/31/2016: AOS Package Delivered
11/15/2016: E-Notifications received
11/21/2016: NOA received in mail

11/28/2016: Biometrics Appointment Letter received

12/07/2016: Bio metrics Appointment

01/22/2017: EAD is being produced (118 days)

07/03/2017: Interview is Scheduled

08/07/2017: Interview Day

08/08/2017: I-485 approval letter mailed

08/10/2017: permanent resident card mailed

08/14/2017: Received permanent resident card (almost 2 years journey)

Can she stay here while waiting for her 1-30 and 1-485 to get approved? Thanks so much!

Yes she can stay; in fact, she SHOULD stay, as if she leaves the USA during the process, there is a chance she will not be allowed back in.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
