Question on Foreign Earned Income Exclusion

 Share

Question is short.. Reading about FEIE I read this:

"The foreign earned income exclusion remains in effect for that year, and all subsequent years until you revoke it."

What does it mean that it remains in effect...will it affect withholdings for example?

The foreign earned income exclusion does not effect withholdings. It's more so in reference to electing the foreign income exclusion option vs. the foreign tax credit option. You can't flip-flop between the two in subsequent years and must revoke the exclusion before you can opt for the foreign tax credit.

Well cause it also said that once you send some  form in you can have withholding stop based on it. I have it on the computer... I'll put a link in a bit :)

Technically,  yes, but that's in other situations. I tailored my response accordingly to your situation.

An employer does not have to withhold US income taxes from wages you earn abroad if it is reasonable to believe that you will exclude them from income under the foreign earned income exclusion or the foreign housing exclusion. So this in effect could be used by a US citizen working abroad who expects to qualify under the exclusion so as to not have taxes withheld. In your situation you are the foreigner that moved to the US permanently.

Hope this helps.
