Hello my name is mohsen . My interview was on July/1/2016, the embassy get back my password ans said your cas in undergoing to administrative processing.

And on December 27/2016 they sent me email ,said   we returned youcase to USCIS.

I appreciate your help.

What type of petition did you file and at what embassy?  That will make it easier to let you know the process to expect

You cna either withdraw the petition and file a new one, or wait to see if USCIS re-affirms the petition and sends it back to the embassy.

 

Do you have an idea why the visa was denied?  For example, what sort of questions did the CO concentrate on during the interview?  Are there any red flags in your case such as large age difference, religious or educational differences, previous immigration attempts, only one or two short visits?

The process of a returned CR1 is as follows :

1. Embassy returns petition to USCIS

2. After 6-9 (in some cases 12 months) USCIS will send the petioner a NOIR request letter (Notice Of Intent to Revoke)

3. Petitioner must answer NOIR letter within 30 days. Reasons for denial will be in the letter and must be overcome with evidence.

4. If USCIS is satisfied with the petitioner's response they will send the petition back to the embassy with recommendation to approve

5. Embassy will give you a second interview

 

In some cases USCIS will re affirm a petition without sending the petitioner a NOIR letter and send the petition back to the embassy.
If USCIS is not satisfied with the petitioners response then the petition will be denied.

 

I advise against filing again and suggest waiting out the process or the next petition will be also denied for the same reason(s).

It is not a good idea to have 2 active petitions floating around out there and you must know the reason for refusal in order
to overcome it.

The entire re affirmation process usually takes one year, sometimes 18 months.

Ask yourself what went wrong in the interview, why the CO thought you were not eligible or if he thought you don't have a

bona fide marriage because you have not shown sufficient evidence to convince him your marriage is genuine and not a sham.
Overcome the reasons for the next interview via NOID response with quality relationship evidence.
