I filed vawa on Mar21. But I learned online 130 was denied on March 1. but 485 still pending because I requested to hold at the time of interview. I was given 84 days from.

 

I sent usps receipt while waiting for notice from Vermont just to show i complied within the time allowed because I read here that it takes months to receive notice. Is this ok?

 

Is there anyway to know the content of 130 decision since I'm not living with him anymore? 

 

Should I send another letter to Vermont that I was served divorce but I didn't know just until lately? 

 

How will divorce proceedings affect my vawa case?

If the Judge granted the divorce after you filed I-360, your VAWA I-360 petition should be ok. If the Judge granted the divorce before your VAWA I-360 was properly filed, then you should submit additional affidavits to explain that the divorce was connected to the abuse. You can file I-360 within two years of divorce.

I heard there is a new Memorandum on vawa....something that has to do with applicants who were married to a green card holder can apply for the EAD and travel permission at the same time they file for vawa. 

 

I know the applicants who were married to us citizens could do it before but now also the applicants married to green card holders are eligible too?

 

Any one heard about it?

Are you talking about March 8, 2016 Policy Memo - SUBJECT: Eligibility for Employment Authorization for Battered Spouses of Certain Nonimmigrants? Which is not what you described in your post.

VAWA I-360 slef-petitioners, who married to LPR can file I-765 under C(31), or just check YES on the Item 12 in Part 10.
VAWA I-360 slef-petitioners, who married to USC can file I-765 under C(9) because they file I-485.

Guys, I have a quick question. I have a pending i765 based on a marriage based i485 that was filed prior to filing for i360. Everything has been put on hold pending vawa approval. Now the issue is, I'm really in need of a job, is there a way that I can file for a new I765 at Vermont attaching receipt of my pending i485 or is my only choice just  to wait for vawa to be approved? Any body heard of anyone that filed i765 twice?

You can apply for EAD and get it approved before vawa if your spouse is a citizen. If the spouse is LPR you may still apply but it won't be issued prior to your approval.

Go to infopass, all my cases filed in July July 2016 were approved already, and most of them found out about the approve with infopass.

I made an appointment on infopass (I am not sure if I am doing it right) already, and the appointment is in April 25th, still a long wait ahead. T.T

Hi All, I am new here I file I-360 in August 2016. 

 

Today in the mail, I received a Prima Facie extension through October 2017. The thing is, I didn't apply for an extension. Is that normal for them to just renew the Prima Facie without me reapplying for it. What does it mean.

 

It has the same language as my original one that said we don't expect to make a decision in the next 180days. I thought they were processing July now and August will be this month or next month. Any August 2016 filers here with notes to compare?
