Dear all

i am currently in the us filed for aos in ocober and received a request for initial evidence. in the letter they have highlighted the form i864 with my mothers na,e who is my immigration petitioner. i am an unmarried children category of a usc. my mom does not receive income so she does not file taxes so my brother is my sponsor for the i864. he initially filed one and we sent it but i am surprised by their request. was i supposed to file two forms of i864 one for my mom and one for my brother? and what to do if she has no w2 or tax forms?

Yes your mom should have filed one also, unless they live in the same household then she would file I864 and he would file i864A

She needs to print out IRS form 4056 and apply for a transcript of non filing. She can attempt online but it will just keep giving her an error message. Also she could include an affidavit (notarized letter) of non employment if she doesnt have any income at all.

Now with your brother it can get tricky because his income will have to meet the minimum for, you, himself, your mom, and anyone else he claimed with/in prior year's taxes. If you have income or assets that can also be used as well.
