Hello,

I'm sorry if this has been answered before, but I'm having a tough time finding it. I'm in school right now (in America) and getting ready to begin the K1 process with my fiance of three years (in England). We have a possible joint sponsor down the road as I am not working right now but will be generating income next year, however, I most likely will not be making 125% or above the poverty limit by the time of our AOS.

My joint sponsor would be my uncle-in-law who wants a little more info on what he would be signing up for. We understand that the worst that could happen would be the government suing if my husband were to become a public charge. I know this would probably never happen as we're both focused on our financial future and make a lot of financial plans, but we like to be prepared and take into account any possibility.

If my husband and I or my joint sponsor went under the 125% poverty limit after we received my husband's green card but before US citizenship, would my uncle be sued for the money to get us back to that poverty limit even if we were to never go on any government assistance? Do they track the income until citizenship or would they really not pay any mind to us unless that happened? Because I know that even if worse came to absolutely worst, we would move into my mother's or even my aunt's house if we ever struggled financially instead of ever making my husband a public charge.

Just something I've been stressing over since we're having a hard time being apart right now and would love to get him here as soon as possible. I tend to be the chronic worrier. Lol

No they don't track it, and it would only be an issue if your husband needed welfare. Also, check into health insurance in your state to see if you can get coverage for him as soon as possible. A health emergency is the one thing most likely to blind-side a person into needing help. Keep in mind that you, as a USC, are still eligible for help even if he isn't. It's also different from state to state. For instance, when we lived in Indiana my husband's only options were insurance through work or Obamacare. When we moved to California we had my income only for awhile. I applied for Obamacare but the state of CA said our income was too low and they immediately enrolled us in MediCAL. I was shocked, and drove to the local office to explain to them that my husband is a legal permanent resident, he can't possibly be eligible for medicare. They looked at me blankly and said, "Oh, no, he's fine, we even cover illegal immigrants here." :o

CITIZENSHIP: 

Biometrics appointment for 2020-03-27 has been cancelled until further notice as all field offices are closed because of COVID-19.

***NOA dated 12/10/2020 USCIS stated they are able to reuse previous Biometrics***

Interview was easy. My hubby's Oath Ceremony is scheduled for February 25th. I can't watch >sad< but happy he is getting his certificate!

No they don't make sure you stay above, just make sure the immigrant doesn't use federal means tested benefits. Some states do allow for state funded means tested benefits of course without any issues. Also emergency medicaid isn't a means tested benefit.
