Moving back to the UK

I am moving back to the UK with my partner, he is American and we have a baby together. I have posted on here before about sponsorship and how to do it and someone mentioned that I could start the visa application while I am working in America as long as I earn over the equivalent of 18,600 pounds to qualify for the 6 month sponsorship for him. Is this correct?

Ideally we don't want to be separated as we have a baby together.

Can anyone shed some light on this or recommend an immigration lawyer who could assist?

Thank you in advance!

There are many forums similar to VJ who handle immigration back to the UK such as Britishexpats. As for an attorney I know that Kitty Falls is London based that does consults for overseas clients. Spousal immigration info can be found here: http://britishexpats.com/wiki/Spouse_Immigration-UK

You are being transferred back to the UK?, could you clarify your income?

You can use your savings from your US Employment instead of income.

I haven't saved the money in the US, it has supported day to day living but it is the equivalent of 18,600 GBP.

If you prove you are earning 18,600 a year do you also need to save it too??

As the requirements state it must be:

You must make £18,600 per year in a job that is salaried employment held for six months and you have a job offer in the UK for the same wage or more that is salaried employment that you will begin working at within three months of entry.

If you have not been employed by your current employer for the past six months (say you had multiple jobs within that timeframe), then you must be employed for up to twelve months total at your current job.

Or

Savings valued at £62,500

If you have any children that is not a UK citizen bear in mind the actual cost of salary must be an additional £2400 per child or if using savings an additional £6000 per child.

Thank you,

I am curious, what if I have been employed with the same company but taken maternity leave. I am still employed but on unpaid baby bonding which WA state allows for. How does anyone think this will factor in?

This is a great UK version of Visajourney for these sorts of questions. Lots of people on there who've been through the same journey. http://talk.uk-yankee.com/index.php?board=17.0

OP has already asked there and received some excellent advice. It is a much better resource than this site, which is aimed at people moving in the opposite direction.
