Me and wifey have decided to bring my 12yr old daughter from a previous relationship to join us here and she want to do the filing as the U S citizen and the step parent what forms should we file and how do we go about it. Im still waiting for my 10yr greencard after aos.

Her biological mother must consent in writing her approval. She will probably have to present the approval in person. Nothing can move forward until then. This process I beleive needs to be done before she turns 16 I think.

I-130 and follow the instructions. Follow the basic plan to bring a spouse only you don't need a lot of the forms. As stated, by interview, unless you can prove sole custody, you'll need the mother's consent for the child to immigrate.

She is been with living with me since she was 4. Do i have to fill a form to prove sole custody?

Doesn't matter how long you daughter has been living with you, she is still her daughter also.

Yes you need court mandated papers showing you have sole custody and the mother has zero. Where is the child living now?

She lives in africa. My question is do i have to include this sole custody papers to send it to uscis wit the I-130 forms or she only need it at her interview?
