Hey guys.. if anyone can shed some light to me dilemma.

My I751 petition was received Sep 13 2016 and haven't heard a pip from them yet. 
I have been following the June 2016 and July 2016 threads, and alot of people have made Infopass appointments, so that they may get an I-551 stamp before their extention letters expire.

Which is fine, I am planning to do just that.

My problem is that my passport that holds my original I-551 stamp and the physical CR-1 visa has expired. I can easily get it renewed but that will mean turning over the old passport once I receive the new one.

Do you guys think it will be an issue that the new passport won't have the original I-551 stamp and visa? I am planning on making copies of both before turning over the expired passport but it still worries me.

I called USCIS and some woman told me I need to file an I-I-765, Application for Employment Authorization and that nothing will be extented beyond the one year extension I have already received. Regardless if the pending I-751 I currently have has not been decided on.

They're pretty well known for talking absolute drivel. Your status has not been terminated, so you don't need an EAD. We're all still waiting. Did you do biometrics yet? 

 

Should add that they will absolutely extend for a year past the expiration date of the letter. If you need information you're better off scheduling an infopass and talking to a real officer. The people on the phones are third party agents who are paid to take calls and end them ASAP.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Biometrics were done Oct 14 2016.

I have no plans of leaving the country any time soon, so I don't need an I-551 stamp for travel purposes, but I will need it to renew my driver's license which expires on Sep 24 2017. Do you think I will have any issues with getting a new one on a new passport?

I asked the customer service agent about it, but she had no clue as to what I was talking about. Kept repeating that my passport has nothing to do with my petition... well duh! I know that!

I don't see why they wouldn't stamp your new passport. Maybe someone else could chime in. As long as it belongs to you and isn't expired then it should be fine.

I was reasonably calm and rational till I spoke with USCIS.

Hello Fellows,

 

Has anyone whose letter expires in September made an appointment for I-551 stamp? I was trying to do it online but every time it says "no appointments available, please check tomorrow". Really? How do I go about it? If I call there directly will it be easier? Please share your experience. Also does the stamp have expiration date also 1 year. Is it from the date of an appointment of from the letter expiration date?

Do you know by chance if those phone agents refer your call to "immigration officer", what kind of immigration officers are they? That was my case. I said I am not satisfied with the information given and I ordered a call from USCIS. An immigration officer called me back and talked about some more specific things but still very vague. I asked what can you see there about my case? She said all is ok. But I really doubt it was one of those officers who really make decisions and that she would tell me if anything if anything with my case was wrong.

I'm really confused about something... My letter date is September, but it's a year extension to the original date in December on my GC, right? Not the date on the letter? I've asked this before, and had that clarified. Is that correct? 

 

And what do we have to do, if December is approaching, and we haven't heard anything? Do we all have to schedule an appt to get a further extention? I would have thought that USCIS would automatically grant a further extention, if they haven't completed it within the year? Maybe not...

 

Can anyone clarify what the process is? I'm getting nervous reading all this stuff about travel and not being able to work etc... I didn't think any of that was an issue if we're PR awaiting update.

Upon expiration date of your letter, you want to make an appointment for Infopass where they will stamp your passport that will be the proof of your legal status here. So basically extension for another year.

Okay, thank you for the clarification. 

This part is so much easier to deal with, given that we're all here now, and we don't have to be apart from our loved ones... But that being said, I'll be glad when all of this is done with. It's very stressful just waiting and having to be on top of all of this stuff. Hopefully they'll get us all in before our extentions expire, and that will be one less thing to have to do.

Tell me about it. No, it doesn't look like they will let us in before September. Apparently all of us will have to go for infopass.

Sounds like absolute nonsense that you have to apply for I-765. This is what you do when your I-485 is pending while your work permit is expiring. So I think she wasn't attentive.

I've just called USCIS and asked: "Sir, can you tell me why now it takes more than a year to process I-751 while just half a year ago it took only 5-6 months?". And he said this is because they received 3 times as more applications during pre-election period since people tried to do it before a new president gets elected. However, it makes no sense to me for 2 reasons: 1. Everyone was sure that Clinton would win so they were not supposed to worry about Trump. 2. How is it possible for application filing to fluctuate if you must file exactly during a period of 3 months preceding the expiration date on your GC. If you have to file from June 1st to August 31st, then you file from June 1st to August 31st and you have no choice. I can say exactly that delays started from applications filed in April 2016. It means, if to believe his words, people who could file from April 1st to July 1st of 2016, suddenly realized that Trump may win and kick out everyone. So June, May and April filers all filed in April and then  July, June and May filers all filed in May and so on and so forth.  Also I asked: "Sir, so do you mean that this is not because they now look into each case very closely and call everyone for interview?." And he said no.  Does it sound reasonable to you?

This's interesting!! I agree with you about not buying the excuse that all applicants surged to file before Trump getting in the oval office. But none of this makes any sense whatsoever.. It's just absurd!! I've been following the processing times and as everyone knows it's almost like things were great up to May 2017, then all of the sudden things started to go slow like really slow.. Every 2 weeks they used to update their processing times and almost finish a month or 6 weeks ahead. Now, every update doesn't even include any advancement in I-751 times.. What a joke..
