So I need to fill out Part 5 on the i-864 form and i seem to be confused. Here's my situation, I'm filing for Adjustment of Status for my Wife and our 3 kids so i will be making a separate i-864 form for each one of them. I have 1 dependent witch is my Mother. Can you guys help me fill this out the right way. Thank you in advance.

I am assuming it is your wife, and not fiancee, since you must be married already in order to file for AOS.

You do not need separate I-864 forms for the K-2 children. If they immigrated at the same time or within 6 months of the K-1 parent, then they will be listed on the I-864 for the K-1 spouse. Check the box for Part 3 #2 and list them as family members there. Part 3 #28 will then be 4.

For Part 5 #1, you will enter the number from Part 3 #28, which is 4 persons you are sponsoring. #2 will be a 1 for yourself. If you claim your mother as a dependent on your taxes, then you put a 1 for #5 as well. That will make your total household size 6.

Include a copy of the I-864 in each of the 3 I-485 forms for the K-2 kids.

~ Moved from K-1 Process to AOS from Family Based Visas - topic is AOS, not K-1 ~
