Hi,

I would like to ask about immigration. I got I-797 notice of action but my petitioner is dead. What should I do or It is over? I read some kind of news on internet that is "Substitute Sponsor in Case of Death of Original Sponsor". It is possible to me. USICS show me "Case was received at local office". Thanks you!

Welcome to Visajourney, and I am sorry for your loss.

Who was your petitioner (husband, parent etc), and might there be someone else who would "take over" sponsorship?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

There is a way I believe, but there are specific rules that I am unfamiliar with. I will move your thread to the Effects of Major Changes forum, hopefully some memebers there can help.

Hi Pennguin_ie

My petitioner is my parent. My brother will. Thanks!

Humanitarian reinstatement may only be requested by the principal beneficiary when the petitioner of an approved Form I-130, Petition for Alien Relative, has died. Humanitarian reinstatement cannot be granted if the petitioner died while the petition was pending
