Timeline

I realize Ghana is slow but the USA is slow also. Took us 18 months to receive the NOIR. I'm wanting to know once u send the rebuttal back how long was it before anyone heard something from immigration.

Good luck to all

Hi our 180 days waiting period is past since October 12 and I'm leaving on the 23rd of this month to go and visit my hubby, I went to uscis office last month and two days later I received an email from Vermont office that they don't have a timeframe, u think I should contact them about our case. Thanks any information will be appreciated.

USCIS has reviewed the case and mailed out NOIR

Based upon with others have posted, can't wait to see

denial points.

Is it best to hire attorney, consultant, or answer myself?

It's best to hire an attorney to handle your rebuttal, that's my opinion, the people is see over coming it used a lawyer

Renee14 - I agre w/MrsBonsu that it's best to hire an attorney who specialized in immigration to answer the rebuttal. They have the experience and can direct you and submit all that is needed to get your reaffirmed. Good luck. Keep us posted.

Anyone know a attorney in dan Francisco that does immigration issues only that actually are good

I don't know anyone, but I did a google search to find mine. I called around and spoke w/them on the phone. Also, check reviews online of the attorney you're thinking of hiring. Good luck.

Renee14 - I agre w/MrsBonsu that it's best to hire an attorney who specialized in immigration to answer the rebuttal. They have the experience and can direct you and submit all that is needed to get your reaffirmed. Good luck. Keep us posted.

Timeline

Finally got my NOIR

Working on limited timeframe since I got it yesterday

The response is due by end of month

USCIS won't allow extension

Doesn't give enough time for professional to complete the response

with christmas around the corner

Need all the help I can get. Any tips on how to rebuttal these?

Here's are consular points I need to address:

1. Beneficiary did not have any pictures of the wedding

2. Beneficiary stated that they talk everyday via Viber but did not provide Viber records.

3. Beneficiary stated he has no other evidence of their relationship

4. Beneficiary stated he met petitioner via a friend in Sept 2014. The petitioner knows their mutual friend through another friend. The alleged mutual friend lives in The Gambia but the Petitioner has not been to The Gambia

5. Beneficiary was asked for more proof of relationship and he provided a plane ticket. He repeated that he had seen her in 2014 from September to December and in July as well. The only plane ticket he had in his files showed that she flew Washington-Brussels-Dakar on March 8, 2015, and returned Dakar-Brussels- Washington on April 20,2015. Beneficiary stated that she stayed with him in July

6. The passport copy shows that the petitioner was in Marocco on September 15, 2014 and Arrived in The Gambia September 16, 2014. No departure stamps from The Gambia were included. No arrival or departure stamps from Senegal were included. No arrival or departure stamps were included from alleged visit in July 2015

7. Beneficiary was asked about what life was like in Washington, DC, and he just says that it's nice. Beneficiary was provided ample opportunity to expand on his response but just repeated that it's nice

8. Beneficiary stated that the last time the petitioner came to The Gambia, she came straight to The Gambia. The ticket provided indicates she went to Dakar

These all sound pretty straight forward. They are telling you exactly what they want.

1. They need wedding pics

2 They need your viber records

3. They want all evidence you can send them about your relationship. Facebook chat, skype, phone ect.

4 They need to understand how you met and the name of the person who introduced you. I would suggest if you can to have that person write something for you as well. You really need to explain this part well since it seems important to them.

5. You need copies of all you plane itinerary. If you booked online print out everything you can about your trips, all dates and

also any hotels that you stayed together in if you did. If you traveled together doing anything send them proof. If you took

pics at each place, label them with your evidence. You need to show them a great timeline with no gaps.

6. They want to see the entry stamps in your passport for each trip. Take clear pics.

7. They need to know about Washington or the reasons why your husband didnt know much about it. You might also want to

include what his plans are for work once he arrives. Also tell them what things he is looking forward to doing. Be creative. they are wanting more explanations.

8. Sounds like the CO is picking at your travel itinerary. Were these places layovers or did you actually visit other places on your trips? If they were just layovers explain that, and include an explanation in your response.

These are just a few suggestions. The more documentation you can give them proving your points the better. When I sent mine in I used a 3 ring binder with each point in a separate section. At the beginning or each section I wrote the number and the statement in front. Good luck. Try not to worry just be as exact as you can with everything.

Unfortunately no ☹️ I was going to wait till Monday but couldn't wait. (Sunday is 30 days). I called immigration, they said 60 days should be a response which puts us to Jan 18. I wrote my senator to check - who knows if that will make a difference. My attorney said they usually respond within 30-60 days. So we're hoping for a Christmas reaffirmation miracle!

Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
