Did they give you specifics of what they were looking for? Often there are some suggestions in the RFE notice.

 

Either way, just bury them in paper, if you can - every joint bank/credit card statement, every bill with both your names on it, your (presumably joint) 2016 tax returns, pictures of the two of you together, affidavits from people who know you as a couple (especially professional people like teachers, pastors, lawyers, doctors, etc), updated medical insurance, car titles, leases/mortgage etc.....

 

If you really believe you sent everything, remember that over a year has gone by since you filed; so you might as well send all the same stuff from the past year that you sent before. 

 

The only wrong way to handle this is to be late in sending a response. At this point, worst case scenario you'll get an interview and  you can prove you're "really married" in person. 

 

At least they have your correct address - based on the threads today, that should be a big relief!

The RFE asks for lease, rental agreement or mortgage.  We don’t have them with both our names on it because my hubby has a criminal record. You know it is impossible to get the lease approved as every apartment complex does background check.

 

we submitted both our driver’s license with the same address.

two years’ tax transcript.

joint credit cards and statements thereof.

 

we submitted all the mails have both our name and address on it (att and joint accounts statements, some electricity bills). 

And  tons of photos for traveling and celebration.

 

there is no way I can get lease rental agreement for RFE.  I don’t know what to do.

New evidence may include updated joint account statements, credit card statements, att statements for both cell and cable.  

My 401k just started in June and I have the beneficiary blank until today. My previous employer didn’t provide 401 k.

 

Life insurance certificate with my hubby’s name on it, but it is fairly new (March, 2017). Many updated photos as well, which may have little to none  help.

 

The attorney is trying to do some affidavits attesting my lease and rental situation, but who knows if it will work.

 

I am super stressed.  My job demands 100% focus but I cannot even fall asleep at all right now. My hubby is very sad to see me like this.

I understand that your husband cannot be added as a leasee, but can he just be added to the lease contract as an additional resident? When hubby first moved here, my complex would not add my husband as a leasee until he had a pay stub, so I had him listed under additional residents and that seemed to be sufficient for what USCIS is looking for - that you're still living together. Hope that is a possible solution!

At the time we filed ours, our life insurance policies were fairly new too (We took out the policies only 3 months before the date we filed) and no questions were asked. So I think you shouldn't be worried about that part. Can you get a Power of Attorney or Wills? Those can be helpful also.

Thanks for your reply.  I talked to the leasing office.  Unfortunately, they said anyone 18 and older has to go through background and credit check in order to have their names on the lease.  This is driving me nuts.  I just don't understand why USCIS treats us like this.  We just want a peaceful life.  Now both of us are super stressed out.

have the leasing office put that in writing...that they are a private landlord, that they know your husband is living with you in apartment XX on their property located at [...], but they refuse to add him to the lease because on date XX  they ran a background check in him and he did not pass it in accordance with their standards.

It's always better to have them earlier and later, but it is what it is now.  I'd suggest that you bombard them with a ton of new evidence and have your attorney write a thorough letter explaining the lease situation. Power of Attorney can be easily made on sites like legalzoom. Good luck!

That's really weird. Having his name on the lease solely as a resident causes them no harm. So he can live with you without a background check ... then what's the problem with listing him? Sorry, this comment is for me being dumbfounded, not helpful for you. :(

^^ I would try that, but not the second part. Just an acknowledgment with contact information that has has indeed lived there. Sorta like an affidavit? Maybe get some of those from some close friends/coworkers stating that you've been living together at the same location for the past X years. Yes, affidavits don't carry as much weight as solid evidence, but hey, every little bit helps.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

That looks weird ,not the screen I use to check my ROC, but I guess that it might just be for the n400.   I know they spent millions so people could file their N400 online and I know they had problems with it at first.  I guess I wont find out until I apply in February. Perhaps the question on the N400 section as I am sure someone there could help you.

Pass.

There is a big 'apply' green button at the top for me, and when I click it, then sign in, it lets me fill out the N-400 form (even though I am not eligible until february).
