I would like to know if I can bring my niece over to study in the US for one semester under a tourist visa? Since she will not overstay the visa period of 6 months and the school does not require to show immigration status to enroll her I would like to know if I could do that?

NO. It is ILLEGAL to bring your niece over to study using a Tourist visa.

Apply for a proper Student visa and pay the school fees if you wish to do so.

Done with K1, AOS and ROC

Tourist visa is for tourism. From here https://travel.state.gov/content/visas/en/visit/visitor.html

Travel Purposes Not Permitted On Visitor Visas:

These are some examples of activities that require different categories of visas and cannot be done while on a visitor visa:

study

employment

paid performances, or any professional performance before a paying audience

arrival as a crewmember on a ship or aircraft

work as foreign press, radio, film, journalists, and other information media

permanent residence in the United States

Heres an old thread but I think it can help as well. http://www.visajourney.com/forums/topic/341149-can-my-husband-bring-his-niece-to-the-states-to-study/

Thank you for all the responses! I will wait until August to meet with the enrollment counselor and see what she would need to apply for the student visa. Thanks again!

School officials are not immigration experts and will not be a good source of information. Study the information on student visa on travel.state.gov or consult an immigration specialist before you get her in immigration troubke.

How old is your niece? Most likely, you will need to enroll her in private school and pay all of the school fees -- for example, no student visas for public elementary schools at all and only limited ways to qualify for one for high school and then only for a limited period.
