Beneficiary to be supporting spouse

Hi, I have an unusual financial situation. Long story short, as the beneficiary I will be the supporting spouse. I receive an annual pension that will follow me where ever I live. Just sent I129F and trying to prepare for this particular hurdle so no big surprises down the line. Anyone else have experience with this type of situation?

I'm uncertain whether the consulate in Canada allows self-sponsoring for K1 applicants. However, the USCIS does not, so you need to find a US resident co-sponsor at least for the AOS phase.

Could you clarify AOS? Affidavit of Support or Adjustment of Staus? I'm still pretty new to all of this!

I meant adjustment of status (AOS, sorry for the confusion), but it's of course also the affidavit of support related adjustment of status I'm talking about. Adjustment of status is what every K1 visa holder is required to do after marriage to their USC petitioner fiancé in the US.

I have not seen any Canadians able to self sponsor, start looking for a co-sponsor or your fiance gets a job.

He is unable to work. Moving him to Canada is not an option, he is too much a part of his children and grandchildren's lives. I would not have him choose.

Are you able to use liquid assets to deposit in a US bank in a sum large enough that it meets the guideline? That was an option we had when they wouldn't count my USC spouse's salary in Canada.

I don't know how K-1s go, I'm afraid. Perhaps someone else can help? I see a poster above indicated that K-1s can't self-fund, which makes no sense to me but who ever said the USG had to make sense?

K1 can self fund, in certain countries, like the UK.

Try using assets, but I'm not sure if you can self fund with those either for a K1. For a CR1 I would just say make sure they're in both names and for the AOS I-864 that would likely work, but i'm not sure about the I-134.

You can certainly try but maybe see if you can get a joint sponsor for "just in case" for the interview?

These are the limits. For a two people house hold, you and your fiance, you would have to bring in 20,025USD a year. Will the money always be in CAD? If so you'd need to make 26016.48CAD, based on todays exchange rate.

Again though, just because you make enough money and you will continue to do so, they DO NOT have to even look at anything you offer them, it's their choice to look at anything more than the basics, the financial forms your fiance will fill out, any other paperwork THEY require, etc.

In the eyes of the government, it's not up to you to support yourself, it's up to your fiance, LPR, or US Citizen to support you and not let you become a burden to the system.


Edit: I do agree with NLR, you'd have a better chance being married and using that income as joint income in both your names for the I-864, than using it for the I-134.
