Hello,

I see sample questions asking about prior visas, usually along the lines of "Have you ever applied for a travel visa"? My fiance has never applied for a travel visa, but he did once apply for a student visa (for which he was denied). If they ask him this question, should he disclose this, or should he only answer the specific question and so no? Any thoughts on if this would damage our case? Thanks for your comments.

Don't try to hide anything because they can see in their own computer system every single (USA) visa he's applied for.

9 Jan 2014 - Filed for divorce in US (never completed)

Nov 2015 - Vacation together in Spain (7th in-person visit with each other)

They don't specify the visa type, they usually ask "have you ever applied for a visa", in which case he should of course answer truthfully. The only time they really tend to specify like that is when they already know the answer to the question.

Actually asks if you have ever been denied a visa

most get denied for this as they tend to apply for themself instead of letting university do it

and /or they do not show enough money to cover a semister

and/ or they apply without being accepted at a college first

If it was any of the reason the above poster mentioned, probably not.

I think the official reason is they said they felt he would be a risk to stay permanently. I'm sure a university didn't apply for him, so that may have gotten them to that point.

One of the primary reasons for interview is to judge the credibility of the applicant. Even if the CO has a lot of this information in his hand they would still ask the question to hear the answer from the candidate. What will raise a red flag is, if they have some sort of information and the applicant contradicts with that or do you nice or tries to present a falsified statement. As such I would recommend to be truthful at all time. You do not have to provide information that you are not ask for it however; if you are ask a specific question you should provide a specific answer. Losing the credibility could be the worst thing that he will have from an interview resulting in to rejection are red flag or whatever you can call it. If the CO does not specifically say's what is that reason for not issuing a visa, I don't think anyone will have any idea on the exact reasons, regardless of whatever assumption we can make, right or wrong.

Everyone is making an assumption on the question based on their experience; where are you rejected, did you have Ever apply for a visit visa, did you ever came to the vicinity of the embassy, could be all questions that were asked to different candidate/applicants. Depending on the question your fiancé should have the right appropriate answer without falsifying any statement or hiding anything. If you are applying for a K-1 visa is in the purpose for him to stay here permanently? Was he the night off of thes was he denied for something or you are just speculating?

I double checked with him yesterday. The documented reason they gave him for the denial was that he was suspect for overstaying the student visa after school was done.
