Good morning,

my mother in law is my I864 Sponsor for the AOS.

I am in the process of gathering all my documents needed.

Today i received the copies of her W2s and 1040s.

I am not sure if we are in need of a different sponsor now, since she filed taxes with her husband together...

and what is Form 1099?

and what is Form 1099?

The 1099-MISC form reports the total amount of payments you receive from a single person or entity during the year you've provided services to them. Essentially this is similar to a W-2. If you work for someone (employer) you are considered their employee, you will get a W-2. With a W-2, taxes are deducted from your pay and your employer has to send those payroll taxes to the taxing authorities. If you're an independent contractor, you will receive a 1099-MISC. Which means you have received gross payments from services you've done for someone. You are responsible to pay your own taxes and self-employment taxes when you file your return during filing season. You will file this 1099-MISC under either SCHEDULE C (for sole sole proprietor), Form 1065 (partnership return), Form 1120/1120S if you are incorporated.

Well, I'm still somewhat new to the process. If your mother-in-law satisfies the income requirements on her own, then you don't need another sponsor. If she only satisfies them with her husband's income, then you'll need, I think, an I-864A to show that the husband agrees to contribute to the process.

The form 1099 is for income earned from other sources that work: interest, dividends, self-employment, etc.

Well, I'm still somewhat new to the process. If your mother-in-law satisfies the income requirements on her own, then you don't need another sponsor. So does that mean as long as her W2s of the last 3yrs are included (which exceed the 125%) but the 1040s are filed as a married couple, we do not need a I-864A ?

Only her husband received 1099s as far as i know. I guess thats irrelevant then?

Also is there an info sheet for employers i could print to present to my mother in laws employer?

Her employer refuses to hand us a paper that states that she is still employed with them etc. They are afraid they might get in trouble.... :/
