Submitting I-130 today

Hello VJ,

We currently have a I-129F open and have our NOA dated 2-12-16. We decided to get married (April 12, 2016), I just got back from Egypt and today I finished the paperwork to submit our I-130.

The first week I was home I called USCIS and asked them what I should do about the K-1 visa process and I was instructed to file a I-130 and by doing this it becomes a K-3 visa. So at this time I am filing a I-130 and supplying all the documents required

The information you were given by the USCIS operator that I placed in bold and red is grossly incorrect and yet another example of why many posters (myself included) refer to that line as the misinformation line.

What you need to do along with filing the I-130 is send a letter to USCIS formally withdrawing the I-129F.

Here are my comments on your list:

• Forget the wedding dress and suit receipts, that's meaningless.
• Don't include copies of the I-129F form or other forms with the prior petition (you filed a petition, not a K1 application, the actual submission of that application would've occurred at a later point in time)
• Do reuse the evidence from the other petition.

Because they are not actual USCIS employees, they are contracted employees who read from a script and if something is not on the script, they make stuff up out of thin air.

Even though you sent the I-130, you still can (and need to) write a letter that you are withdrawing the I-129F. All you need to do is write that you have gotten married and have begun the spousal visa process.

Dont stress he suggested you dont send the evidenciary info if its gone it cant hurt you...was it needed no but its not gonna hurt you.

You can still send the withdrawl request for the 129-f.

Procedures changes maybe the person is unaware or your mistaken in what was said...

PS one thing i do is i usually call a place a few times to see how many answers i get to the same question i call at least twice if answers very i call a third its a habit my mother taught me always double check

Send it to the service center on the NOA1 for the I-129F, you will need to include the receipt number along with full names in your letter. Since you are taking action to get the I-129F withdrawn, the brief time that they would both be open would not be detrimental.

Ok then send it to the california uscis where you got the noa1 if you get the noa2 you may need to contact nvc as well.

oK, I have the letter finished and will send it this morning.

Yes, we received the regular NOA1. We check the case status regular and nothing seems to have happened with it.

I have the letter done and a copy of the NOA. I will send it out in the mail today.

I hope they will be able to understand whats going on...now I have no faith in the process........contract employees who know nothing...SMH!!

Theyre call center employees, not USCIS government workers. Is what it is.
