I suggest you call the USCIS to confirm whether you should start a K1 petition for your boyfriend. It may be a long wait but it would be worth it.

Not to snoop but you also initially called this person your 'friend' not boyfriend. Please read the guides and understand the K1 process from initial application to him getting his greencard conditions removed. Be sure you want this kind of responsibility as opposed to him just waiting on his green card through his father.

If you call without a case number you will get nothing. If you call and ask advice even with a case number you will get nothing. They will only tell you to consult an attorney. If they did offer any information, it would be more likely to be wrong than the correct answer.

If you call without a case number you will get nothing. If you call and ask advice even with a case number you will get nothing. They will only tell you to consult an attorney. If they did offer any information, it would be more likely to be wrong than the correct answer.

Since its a unique situation I don't see the harm in calling someone to get an official answer, whether it be the uscis or an actual attorney. I'm not the only one on this thread to suggest this. What's the harm?

Not exactly the most complicated question and it has been answered multiple times.

If somebody wants to use a Lawyer then go for it, this is a self help site. Some things are beyond this site, this is not one of them.

Because USCIS customer service is not a legal advice number. It is there to answer questions about the status of your currently active case. The people who answer the phones are not even USCIS employees, they are employees of a call center company who have been trained to look up cases status only. They are not immigration agents, they are not lawyers, they are call center workers only. If you have a case number and its your case, you may get forwarded to someone who actually works for USCIS, and they are not allowed to offer legal advice. Which is a good thing as they are not qualified to offer legal advice.

so I called USCIS,

they gave me good information,

I can file the K1, but his fathers petition would be eventually canceled, money and time lost...so not sure yet how we will proceed, need to all discuss...
