Hello!

My husband filed the I-130 in February and I filed the I-485 on March 24. We did not file concurrently because we were waiting for some tax documents for the I-485. My I-130 is still "in process," however I already have a biometrics appointment next week. How can this be possible?​ Does that mean our I-130 has been approved?

hi

did you include a copy of the i130 in the adjustment package? if not, they will go separate ways

you should have waited to send everything together, if you were to file concurrently, there was no sense into sending the i130 by itself

the i130 alone takes around 5 months, the biometrics are for the other forms you sent

immigration might get confused, because i130 alone are usually send for those going through consular processing in their country, so the approved 130 might end up at NVC

The I-130 will be matched up with the I-485 and will proceed as a concurrent filing. It will not go to the NVC.

The I-485 wouldn't have been accepted unless the priority date had been established by also sending a copy of the I-130 NOA.

As stated though, it was pointless to file them separately.

The I-130 hasn't been approved, and won't be until the interview. Biometrics is the next step after filing an I-485.

Yes, I have included a copy of the Form I-797, which states that my I-130 is in process. The USCIS website says that "After you receive Form I-797, Notice of Action, showing that the Form I-130 has either been received by us or approved, then you may file Form I-485. When you file your I-485 application package, you must include a copy of the Form I-130 receipt or approval notice (the Form I-797)."
