Hello,

On the USCIS website, there is a "following to join" benefit for those who came over as a permanent resident without their child. This can be activated by filling out the I-824 and the child will follow my spouse here and get a permanent residence.

I'm weighing the cost-benefit of filling out the I-824 ($405 filing fee) to reopen the K-visa or filling out a new I-130 ($420 filing fee) from the US Citizen spouse. Which way is fastest and most cost effective? Will there be the same fees at the embassy abroad for either form? Medical is required for both? I'm going to call the embassy again, but this has been difficult to figure out. Thanks in advance!

hi

not possible, the follow to join for a K2 derivative of a K1 visa, has to be within a year of the visa granted

the only way now is to file the i130 as stepparent

There is no time limit for a follow-to-join beneficiary to seek visa issuance and admission using I-824 (especially for K2 derivative of a K1 visa).
