Bringing a son on 10 Years GC (merged and moved)

Hi There Visa Journey Members,

I am a 10 years GC holder here in the US. I would like to bringing my son from the Philippines from my previous boyfriend.He is 13 years old now. I am curious what are the docs need to apply or petition him to come to the US with us ? Also I was a DCF filer in the Philippines. How long it takes for me the process before i can bring him in here to the US? Thanks alots and any info very much appreciated.

Hi all,

I am a natural born american. I married my wife a Filipina and she is now a Permanent Resident. Now we want to sponsor her son from a earlier relationship. She was never married before I met her. The father of the child is MIA. The child's Filipino birth certificate is in the family name of my wife. I have heard stories of Immigration not approving a child in this scenario unless there is a document signed by the birth father.

Anyone know about how to deal with this type situation??

any info on how to successfully immigrate my stepson would be greatly appreciated.

You should have posted this in the Philippines section. You have nothing to worry about. In the Philippines all rights to a child born out of wedlock is with the mother. The consulate follows the laws of the country where the child is coming from. Nothing is needed from the father.

You as the USC can file for the petition for your stepson if the marriage occurred before his 18th birthday.

Required Documentation

• Form I-130, Petition for Alien Relative (signed with proper fee)
• Evidence of your U.S. citizenship:
  • A copy of your U.S. birth certificate OR
  • A copy of your unexpired U.S. passport OR
  • A copy of Consular Report of Birth Abroad OR
  • A copy of your naturalization certificate OR
  • A copy of your certificate of citizenship
• If you are a permanent resident, you must demonstrate your status with:
  • A copy (front and back) of Form I-551 (green card) OR
  • A copy of your foreign passport bearing a stamp showing temporary evidence of permanent residence.
• If your name or your child’s name has changed, proof of legal name change (may include marriage certificate, divorce decree, adoption decree, court judgment of name change, etc.)
• Proof of relationship (see chart below for case-specific requirements)

Step-parent (step-mother or step-father)

• A copy of your step-child’s birth certificate issued by civil authorities
• A copy of your civil marriage certificate to your step-child’s genetic or legal gestational parent
• Proof of the legal termination of all previous marriages for you and/or the genetic parent or legal gestational mother (divorce decree, death certificate, annulment decree)
