Hi Everybody,

I hope you are all doing fine. i just needed some advice/information regarding filling I130 . My wife she is US citizen and we got married here in india and she just filled my i130 petition and sent to phoenix, Az as she told me she sent on 03/30/2016 and till date she didn't got Noa 1 . even i m not clear with this situation when it will get accepted how long it gona take to get the petition approved and usually how long it takes them to cash out the check and send receipt or petition tracking number. and what to do after that. as she just sent i 130 what to do after that for the visa and what she have to do like wt docs she will be needing from me and what docs she hv to fill.Kindly please guide me. wts exactly is the procedure and she said she sent the check of 420$ with i 130 . and after that how much we have to spend till i will get the spouse visa.

She should be receiving her NOA1 any day now. Has the check been cashed? And did she happen to include the G1145 in your petition?

Now you need to wait for your petition to be approved, after which it will be sent to the National Visa Center. This will likely be about 5 months from now (approval) so you have plenty of time to read up on the NVC process. I would suggest you read the NVC wiki page on this site, using your computer, to understand the process.

You will have to pay 2 more fees at the NVC, a fee for your medical, and then a fee to produce your GC after your visa is issued.

Expect the entire process to take about a year.

Thankyou kastrs for your reply . she jus sent i130 alone not the visa application yet, till yesterday she said thy didn't cashed check , yes she included 1145 with it thts y i asked wts after i 130 will gett approved how she will apply the visa how much fees we gotta pay still?

The G-1145 form is the E-notification form. If she did include that then she will get a text and email notification of them accepting (receiving) the package. The first Notice of Action form (referred to as NOA1 on this site) will state which processing center it was sent to along with the Receipt number. the average wait time for an I-130 petition to be approved is 5 months. It could be less than that. It could be longer than that. Refer to my timeline in my signature. Once she receives the NOA1, create an account on https://egov.uscis.gov/casestatus/landing.do and choose the text and email notifications. This is a good back up to see if they have touched your petition and getting text/email notifications whenever there is an update. Please note -- updates won't be often and you probably won't get one till at least 5 months in at the earliest.

I would highly advice you and your new bride to read through the NVC process thoroughly. Become familiar with it and understand it. Start preparing for it now. Start gathering your documents that will be needed at the NVC package now so you will have everything by the time you get to that stage and need to submit it. Also read over what's on the Department of State website regarding the process as well: https://travel.state.gov/content/visas/en/immigrate/immigrant-process/approved/contact.html

The more you read the better you will understand and start feeling comfortable with the process. Read it over and over so you don't miss anything. NVC stage will go as quickly as you make it. the only thing you can't control is the waiting from their side, but don't delay your process because you waited until you get to the NVC stage to start gathering your documents. Some documents could take longer to get a hold of (for example the India Police Clearance Certificate).

thnx bro for you reply but all i want to know at this moment thts when we gona recieve i130 noa1 reciept as she sent on 30/03/2016

its about to come....she will receive a letter in mail...sometimes mail gets lost or something if you don't receive untill 30/04 then contact them

Hi everybody,

I want to know about one more thing .my wife which is currently in us and already sent my i130. She wants to visit me soon as well in India on our marriage anniversary in july , and I was bit stressesed and confused like if she got pregnant which nobody knows in case and after that she travel back to us . what's gona happen then can I get my tourist visa in case if spouse visa process gona take long to take care for her and our baby .and what legal responsibility I gona come under as I am not aware of us laws she already HV a kid with her ex will I have to financially support her kid from her ex as well in future? Or do I have to still complete this spouse visa process if she gets pregnant here and give birth to our baby in US. Can I get emergency or any kind of visa if she gets pregnant and goes back to us.

Awaiting you kind advice friends its confusing and bit stressed for me .
