Hello,

Here is my situation. My fiance has no tax filling history because of internships/personal projects/odd jobs in the tv/media field. I did my interview in February and the only thing that is missing is a i-864 and/or W2 (which he will only have in 2017 since he started his job in January 2016) We obviously need a co-sponsor but the problem is we still don't have one and we need one before the end of July (before my medical expires). He asked some family members and they refused.

My question is if we convince one of his family members to co-sponsor, can they withdraw right before we start the AOS process? Since my fiance will then have a W2 with sufficient income in January 2017? I'm starting to take it personally that they don't want to co-sponsor :(

The way the I-864 has been interpreted in certain jurisdictions, I'm surprised anyone is willing to be a co-sponsor. Its one thing to put that much financial risk out there when you're trying to get the person you love into the USA. Its totally another thing to put that much financial risk out there for someone you likely hardly know.

Why take it personally?

Many people consider cosponsoring an immigrant a huge deal. It is basically saying that the immigrant and/or government can come after them for support. Now it is likely not to happen but some people just don't want to deal with it at all.

My advice is instead of pushing the cosponsorship, speak on your relationship instead. Have them Skype or text your fiance. Share good stories you have together. Build the confidence that your fiance won't go missing as soon as he gets off the plane. You still have time.

Any USC can be a cosponsor, doesn't only need to be family.

I'm starting to take it personally that they don't want to co-sponsor

Why may I ask? This "problem" you guys have should have been known and vetted out before you even filed.

Worst case is that you withdraw the K-1 and refile when he has his own income.

I completely understand that it is a financial burden but we are only 6 hours apart. There is only the Canadian border separating us and we have been visiting each other and our families almost every month since 2012.

He had a best friend ready to do it but he lost his job the day he was going to ask for the financial proof.

Can it be my own USC family member? I would find it weird for the situatuon but I'm thinking worst case scenario.

I guess because his family knows me very well and I didn't think they would be that suspicious of me. The ''problem'' arose when his father said he would do it a year ago but backed down one month before my interview. We have no luck lol

To be honest with you If I had a son or a daughter that wanted to marry a foreign citizen I too wouldn't do sponsor.

You can't expect someone to take the financial risk and burn on a person that's not even married to the son or daughter yet. Plus even if they did and you AOS then divorce the son or daughter they are still under contract with you and they are still responsible for you.

So I can understand why they wouldn't co sponsor for you.

Doednt the USC have any friends or other family members they could ask? If not then the only thing is to wait until your fiancé earns enough money to sponsor you on his own.

It's not like you guys are married yet and I'm sure you can both visit each other until such time you meet to he requirements.

I understand you want to be with your fiancé and you want to get married but you really have to think about it with your foot in their shoes.

Just keep reaching out to friends and family members.

Reminds of a phrase my friends and family like to use... "I know 'em, but I don't really know 'em."

Meeting family doesn't warrant cosponsoring a visa. Or cosigning for a car. Or lending a downpayment on a house, etc, etc. Get the idea?

I wouldn't take it as a personal shot against your character.

Any USC or green card holder can be a cosponsor.

Won't you have to submit another affidavit of support when you adjust status, after your wedding? I wonder if it would supersede the one submitted to the consulate and "release" the cosponsor. No idea, but maybe something to look into :/
