Hi,

Am bit anxious filing for removal of conditions without a lawyer's help. All my past stuff got handled by lawyers, so never worried about anything going wrong. But wanted to save some $$ so figured i'd try to file for removal of conditions on my GC on my own.

Filing joint with my husband. Are these sufficient in terms of documentation?

- Our old apartment lease together for year 2014 and 2015. We moved in with elderly mother in law end of 2015, so not sure my name is on lease yet. Trying to get that. May take a few days to get and don't want to delay process. Currently has husband and mother in law's name (they used to live together before marriage).

- Tax returns for 2013, 2014, 2015 (didn't get the tax receipts, and moved, so don't know how to and don't want to delay the process)

- We don't have joint bank accounts. We kinda do our own stuff and it just never works out with joint accounts for us.

- Credit card statement showing husband's name on it, so both names on it

- My retirement statement (from dec 2014) showing husband as beneficiary in case of death

- Medical lab bill showing husband as patient and me as responsible party

- Health insurance claim showing husband's doc visit (he's under my plan), of course has my name on it

- Boarding pass copies for our Miami trip together this year

- E receipts of our trip together to India in 2013

- Receipt/confirmation email to me (my name's there) for hotel booking and show's husband as the person to check in (NJ trip this year)

- Costoo membership cards (joint account)

- my indian passport shows name of husband listed

- my NY ID card with husband as emergency contact

- Photos of course of our trips, time with each other's friends and families

I guess my package will go to the slow Vermont center. I have about 2 1/2 months before conditional card expires.

04/12/2014 - Received transfer notice in mail stating file transferred from Nebraska to NBC Lee Summit, Montana (so disappointed as I thought it was at local office now).
04/14/2014- emailed Nebraska and scopscata to see what's going on with file due to conflicting info I've gotten and NBC doesn't even show processing I485.
04/14/2014- Got response from scopscata saying will look into email, forward to resolution team.
04/14/2014- I485 updated to "485 was transferred and is now being processed at USCIS office"
04/25/2014- Text message and case update online "testing and interview" stage.
05/06/2014- Text message and case update online with interview date of June 11, 2014.
06/05/2014-Notice sent by NYC acting district director/office that interview date is Aug 21, 2014.....??????????? No change online
06/11/2014 - Interview for AOS. I130 was already attached. Approved and got passport stamped. YAY. Thank God.
06/19/2014 - Case updated online with text and email saying new card mailed.....

06/21/2014-Condtional GC received along with welcome letter.

- Tax returns for 2013, 2014, 2015 (didn't get the tax receipts, and moved, so don't know how to and don't want to delay the process) You can request from their website https://www.irs.gov/Individuals/Get-Transcript, they will mail it within 5-10 days OR just go to your local IRS office, request and they will print it for you (they will more likely include the W2's as well)

- We don't have joint bank accounts. We kinda do our own stuff and it just never works out with joint accounts for us. Even if you don't have joint account, you can still submit day 1 you open 'til present and of course your husband as well

- Credit card statement showing husband's name on it, so both names on it this is good 2yrs statement is better

I guess my package will go to the slow Vermont center. I have about 2 1/2 months before conditional card expires.

- How about Car title, is your name in it? Driver's license (both of you have address there), Car insurance? Any AAA membership or other kind?


-Utility bills like phone, internet, cable, water, power (both of your name on it)

This is my cover letter to USCIS, includes my list of docs I have so far...

Dear USCIS examiner:

Enclosed please find an I-751 petition for removal of conditions of permanent resident status regarding my wife, (A). Please also find a check for $590, the fee for this form. We are happily living together and request that this petition be accepted for removal of conditions on the residence of my wife (A).

Enclosed also please find the following documents to verify the status of our marriage and ongoing relationship:

  • Copies of the passport and green card of wife (A). Passport shows name of spouse (B).
  • Copies of my U.S. passport (A)
  • A partial copy of our 2013, 2014, and 2015 joint US tax return. Also included are the IRS tax transcripts.
  • Copies of joint rental lease for year 2014 and 2015 (Address 1).
  • Also included is lease from December 2015 (Address 2). We moved in with my elderly mother © to take care of her as she was living alone. I used to live with her prior to marriage in 2013 and held a joint lease with her. Moved out after marriage in 2013 but the lease always carried mother and my name on it. In Dec 2015, when we moved back in to take care of her, added wife A's name to the lease as well.
  • Copy of life insurance policy for wife (A), showing me (B) as beneficiary.
  • Retirement policy for wife (A) showing me (B) as beneficiary.
  • Copy of my (B) health and dental insurance cards from 2015 showing a joint policy. Note, as of December 2015, I am no longer working with that employer or carrying those insurance policies.
  • Copy of 1095-B showing health coverage for year 2015 from wife’s (A) employer. Insurance coverage provided by wife’s (A) employer with spouse (B) covered under the plan.
  • Two different medical lab bills and a health insurance claim showing both our names together. Wife’s (A) health plan covering spouse as well.
  • Copy of our master card showing a joint account from 2016. As part of rebuilding my (A) credit history, I did not have any credit cards until this year as we are now planning on purchasing a home within the next year.
  • Front and back of NY ID for wife (A) showing emergency contact spouse (B).
  • Boarding pass copies for our trip together to Miami, FL this February 2016
  • Copies of our E-tickets for our trip together to Delhi, India (2014) to visit wife’s (A) family.
  • Pictures on our vacations together along with pictures taken with family members.

You may feel free to inquire at any of the sources of enclosed documentation for validity and you are always welcome to visit our home should you ever desire to do so. Please advise me if you have any further questions or problems related to this petition.

Please advise if above letter looks good and if the list of documentation is sufficient. We don't have joint credit cards from before as his credit was bad and now since we want to move to buying a house at end of year, we are in process of rebuilding credit history etc and got joint card, him under mine. Also should I mention we don't have joint bank accounts. We tried a couple of times but since we don't maintain it, it never works out and we just do our own thing. I don't think I have any copies of those accounts though...all were online statements and I've closed those accounts.

Trying to send this out asap. Should I be filing a change of address too as I moved since GC filing. I just got forwarded mail from postal service that USCIS had sent to old addresses. One is a reminder notice, the other was opened and had a change of address form...Not sure what I missed there.

Its kinda wordy.

Thanks NLR, I cut down the wording and made it fit into a page now.

How does the documentation look? I felt I need to explain the current lease with hubby and mother in law's name (it has an addendum now that I live there with them) and the fact we only have joint credit cards as of recently together...needed to be explained more and hence more explanation in letter. We don't have any car/mortgage etc yet.

Should I be adding why we don't have joint bank statements?

Do you think we should include an affidavit from someone who knows us and if so, should it be notarized? I read it on USCIS form instructions but here on forum seems some people think it doesn't carry weight. Just want to build a strong case.
