Hi vjers☺ We are planning a road trip during my husband's spring break, from Delaware-Washington-Virginia and anywhere down that road but not as far as Florida. We recently got married, 2+ weeks ago. Yesterday my visa expired and we have not filed AOS yet so I am out of status as of the moment. Question is will I be good traveling to the said states given my status? Or do I have to avoid certain states? I'm anxious for the trip but still want to be careful. I need your ideas guys. Thank you so much

Using a car for your trip will be the best way to travel. Just carry I94 passport and marriage certificate in the event they are needed as proof. You are going through some very nice countryside and rich with history. Enjoy your trip and when you get back get the AOS taken care of.

Technically your not legal, I was under the same situation, wanted to drive out of state so my wife could visit her sister in Ca. I did not risk it untill i have a receipt at least showing I had filed my AOS. Just my opinion after all we had done to get to this point it is not worth the risk. You could get anybody on a bad day.

Thank you all for the reply. I will definitely take those with me Greenbaum☺ we are not leaving until next weekend so we are still trying to accomplish the AOS before we leave.

You're not going to states with border patrol check points, that I'm aware of. Those are the things to worry about, and some of the low priced bus lines that occasionally get stopped by ICE.

BTW its not your visa, but the I-94 expiration that matters. Your visa is expired the day you entered the USA.

After the I-94 expires, your next stage of legal presence begins with the date of the NOA1 of your adjustment of status application.

The worst that can happen is you'd be detained then ordered to file the AOS within a fixed time frame. So don't stress on it too much and enjoy your trip. But of course carry the documents mentioned earlier.
