Your K3 will more than likely be denied anyway due to they are almost obsolete now. So they will close it out and you will go the CR1 route.

K3 is obsolete, the I-129 F will be administratively closed at NVC and you will follow the CR1 path (I-130).

You barely give any information at all so it's hard to guess where you are at in the process.

An approved petition can be returned to USCIS with recommendation to revoke if the CO feels you don't have a genuine relationship.

A returned K1 would expire. A CR1 would give you a second chance with a rebuttal after receiving a NOID/NOIR, an appeal will be useless

for either one.

A K-3 Visa is issued to a non US Citizen who is married to a US Citizen. This is technically a non-immigrant multi-entry Visa with a validity of typically two years. During the two years that the K-3 visa is valid the holder may either file for Adjustment of Status (to become a Legal Permanent Resident of the US) or await their I-130 to be approved in which case they can return to their country to be issued an Immigrant Visa (upon entering the US on the immigrant visa they will become a Legal Permanent Resident). If the K-3 Visa Holder files for Adjustment of Status they may reside in the US while their Adjustment of Status application is processed. Children under 21 of a K-3 Visa holder may also be eligible to receive a K-4 Visa allowing them to enter the United States with their non US Citizen parent and ultimately as well apply for Adjustment of Status.

In recent years very, very few K3 make it through and it is considered obsolete. If married you do the CR1 and if not you do the K1, no the K1 is

not obsolete, is good to go. There is no more residing in the US to wait out that process which the K3 was initially for. Waste of time now and if married

you go the CR1 route.

I mean even the marriage is bone fide and genuine with appropriate documentation and the requirement is present can the consular denied the visa because of age gap between the couples ?
