she had ALL the required documents and proof of relationship and still issued 221g and the 221g doesn't even list any additional or missing documents needed, only says "no action required at this time" so if no action is needed and all documents were submitted and visa fee paid based on an approved petition then why the hell not issue the k1! so ticked right now about this.

still in AP, we requested the case to be transferred, also I contacted my congressman several times and they emailed me yesterday saying the case will remain at AIT until they finish the AP then sent to manila , my fiancé is in Philippines as of May 26th.

we are getting the runaround, first manila says send a formal request to them and they will transfer, then ait says no request been made by manila, then ait tells congressman ap needs to be completed there before transferred. yet....ait tells us to send formal request to them to transfer to manila , so now we have both embassies saying they need formal request and one embassy saying the need to complete the AP there... my lawyer says he wants 500.00 more to email these embassies because this is over and beyond the contract, the contract was from petition thru AOS and since it went into AP now he wants more money and this wasn't stated in our contract so im at the point ready to fire his a$$ and we withdraw K1 and do CR1

August 4 2017 - I-129F Sent to USCIS

August 7 2017 I-129F Delivered

August 9 2017 NOA1 Sent out

August 14 2017 - Received email from Lawyer NOA1 received

August 28 2017 - Returned to USA/NOA1 was in the mail waiting for me delivered on August 14th according to my brother who collected my mail

September 7 2017 - 1 month into waiting for NOA2

October 7 2017 - 2 months into waiting for NOA2

November 7th 2017 - 3 months into waiting for NOA2

If we do cr1 , in manila , do both my wife and I attend the interview? or is it like K1 that only the applicant can attend. we are contemplating to withdraw k1 and then marry then file cr1.

already asked the lawyer what to put for "have you ever applied for a visa to usa before" on the cr1, he said put 221g

AP is based upon the embassy having questions on entry into the USA (apparently erroneous) ... just the same you have to let AP run its course.  Switching from K-1 to IR/CR-1 will NOT remove this question.    

 

I am not sure what an attorney can do regarding this .. not even a congressman has much pull over the Dept of State. and embassies.    

 

Just have to be more patient.

Like said switching visas types isn't going to fix the issues ... as tough as it is just need to be patient, let AP run its course.  If they don't find the errors then you have more important issues to handle ..   how come there are entries into the USA in your fiancee's name (and passport?)  .

 

As for your question, have you ever applied for a visa before - YES.      Result:  .. at this time if you withdraw the petition, then it would be withdrawn (not 221g).   If you stay the course you will have a different answer.

we are just guessing that's the issue since at the interview they asked her 3 times has she ever been to USA and all 3 times she said no, which is the truth. she has never applied for a visa nor has entered the USA. , we don't know why its in AP, never was told and they didn't tell the congressman either as to why.

there are no entries in her passport to usa, only to Taiwan.

OK .. just guessing, got it.   Just the same .. be patient ..  if there is a real issue, trying to dodge it won't fix it.

now were are stuck with the decision to either she go back to Taiwan and work and wait for the ap to finish and let them know her new contact info and request manila to cancel the transfer since its still at ait , or she stay in Philippines and wait the ap then wait the transfer to manila. according to an email from ait to the congressman office if its in ap then that embassy will not transfer the case until they complete the ap. so now we are trying to decide which is best. go back to Taiwan and wait the ap or stay in Philippines and wait for ap and transfer and wait for them to contact her.

Any idea what this mean, I'm under k1, they updated my status and date created last August 7 and it change to non Immigrant but till no news about it. I got a 221 g and I sent it already July 30 and embassy received it July 31. My status keep updating the date August 2 and then August 6 then this is the last one. I'm worried about it. TIA

Wow that’s a very unfortunate situation. I guess as Hank stated it’s just a waiting game.  Our prayers goes out to you and your fiancé that this gets resolved soon. I know it’s difficult but thanks for sharing your experience.

That’s a good sign they are touching your case. It will be issued soon based on other people’s experience. That’s is what happened to our case and it changed to  issued shortly after it changed to non immigrant

That is normal, everyone goes through AP .. how long is what varies.   Switching to non-immigrant is normal also, that's usually done just before the visa is issued.  ;)

Still no update about our case, hopefully next week. This is so stressful but all I can do now is wait. 😔
