Hi All,

I am just trying to understand the process for K2 visas for my K-1 FIance's (now wife) children.

  • My finance is from the Philippines received her K-1 Visa in October 2015
    • Note: 2 of her children were included on the Visa application but will travel later in 2016
  • She traveled to the US on 1/16/2016
  • We married on 2/18/2016
  • I am now submitting the AOS and EAD applications for my new wife

My question is, do I need to do anything for her children yet? My understanding is this:

  • The children will apply for a K2 Visa (assuming I do that on the Manila Embassy site)?
  • The children plan to arrive in the US in July/August of 2016
  • When the children arrive, I can then request an AOS at that time (I am assuming my wife's AOS/EAD will be approved by that time).

Any clarification will be most helpful. Thanks for all your help as always.

Charlie

Process is the same for the children as it was for your wife. Follow the embassy instructions letter, a few things are age related, but the process is the same.

Do make note of the ISSUED date on your wife's visa, the K-2 visas must be ISSUED before that date, so start early enough to complete the interview and get the visas ISSUED.

And of course there is the CFO sticker to get as well.
