Great news our K1 application has been approved.

The interview was perfect!

So now i need some help people . . . if you amazing community can help?

My company has a office in the UK and the US.

I am awaiting my passport to be couriered back and i have a meeting with my boss tomorrow in work to tell him that it has been.

They want to send me to the US at the beginning of March to train people and i understand that if i enter and leave then my application can be voided.

So what i am proposing to my manager is that i transfer to the US, take some time off and get married when i am over there, we are having the big wedding next year (cant wait).

Questions i have is;

  • If they do transfer me can i not work until i have my SSN?
  • Would it be better to work from the office until i get the SSN then transfer?
  • How long can i travel out of the US after i am married? I would like to come back to the UK for a week at the end of the March.

If they dont approve my transfer then i am leaving at the beginning of April.

Can anyone help?

Er I don't think you understand how the k1 fiancé visa works. This visa gives you permission to go to America to get married and then apply for adjustment of status. If you leave before you have applied for adjustment of status and applied for and obtained advance parole then you have abandoned your ability to adjust from the k1 fiancé visa. You would get out of the us but not back in.

can i not work until i have my SSN?

*You will need to go to the us get your Ssn, marry, file for adjustment of status and either receive your green card or the ead. You cannot just rock up and work.*

Would it be better to work from the office until i get the SSN then transfer?

*Have no idea what you mean here but if you mean work though your London office and be paid through them that is a bit of a grey area when all the work is being done in the us and you would be doing work of training us employees. I think some Canadians might have done this but not sure if uscis found out.*

How long can i travel out of the US after i am married?

Also now that you have been approved and have the visa in your passport you will end up using it the next time you go to the us so there really isn't an option to forum using esta anymore, one Canadian got to delay activating it but they have different arrangements in terms of visas anyway especially when they do land crossings so I wouldn't take anything they managed to do as being possible for everyone.

Sorry, to clarify; i think my current employer would not transfer me over to the US payroll and let me work out the US office as a UK employer if i ask.

If i am reading this right;

I shouldn't go over at the beginning of the March month, get married, then come back for a week?

The next step is get SSN, get married and apply for adjustment?

How long does the adjustment take?

I dont really want to loose my job. How could i resolve this without leaving the company.

It can take anywhere between 3 months and 18 months to adjust and get the green card though some have taken longer.

When you apply for the green card you can also submit forms for advance parole and ead. The advance parole is to leave the country for a short time and come back and an ead is for permission to be allowed to work. The advance parole and ead should be adjudicated in 90 days.

I was lucky in that my ead took 80 something days and arrived the day of my green card interview, having an interview meant that I got my green card a lot faster than other k1 visa recipients who applied the same time as me for adjustment of status.

Most people with a k1 fiancée visa have been getting an interview waiver so they don't have to interview but due to delays in processing them they have to wait 12 to 18 months to get the green card. Even though the interview freaked me out it was so much better to have it done and get my card.

Your permanent residency doesn't start till your green card is approved so that taking longer initially delays the removal of conditions and the ability to apply for citizenship.

How would you be proposing to get back to the us if you did go in March, marry and return to the uk?

Most of us left our jobs in the uk when we moved to the US, There are a couple of visas for those looking to use their job to transfer from an overseas office to the us office but that is a different route to the one you chose.

Apologies, I have my green card.

I went to the embassy and they have approved.

Embassy's do not give green cards they give visas. You have applied for a k1 fiancé visa to go to the us and marry. You won't get a green card until you marry and apply to adjust your status.

OP Please look at this website on a pc and look up the guides it has the process laid out and explains all of the steps.

No I know he can't but it seems like he doesn't even know the visa he have got.

I have gone through the K1 process and have this now approved. I interviewed at the us embassy in london and they have taken my passport to return for immigration.

I am speaking to my employer because they have a US and a UK office. I am seeing if they will move me to the US payroll and i want to know about coming in and out the country and also what to do when i enter the US and the 90 days start to count down

Please correct you timeline/profile.

You do not have a Green Card you have a one time entry visa to the us. You can enter once then you have to get married before 90 days.

After marriage you'll have to Adjust your status (AOS) to become a permanent resident (Green card holder) It cost $1,070 with that package you send in the forms for AP and EAD (these are free when filed with the AOS).

You get your AP/EAD in about 60-90 days and when you have those then you can work and leave then country and be able to enter again.

You really need to read up on the K-1 visa and the AOS.

Uh yeah looks like people have pointed out most of the issues here.

I just wanted to point something else out as well.

You say in your post that "we are having the big wedding next year (cant wait)."

Did you mean next month? You have will have issues waiting a year. After you are approved, the visa is only valid for 6 months, meaning you must enter the US within those six months. There is a way to renew it but I believe it requires attending another medical. (This could be innacurate, but I know there is a process you have to go through, it doesn't just last forever without you doing anything).

Once you get to the US, you have 90 days to marry.

So unless you plan on renewing your visa before coming to the U.S., you will not be able to wait until next year for a wedding. Is it possible you meant next month?

As others have mentioned, it would do you well to read the guides and get better informed about the process and guidelines after you receive your K-1 visa. (Which is what you have, not a green card.)
