The children's tourist visa application should not have any influence on the mother's IR-1 process.

On the contrary, a mother seeking to immigrate to the US could make it more difficult for the children to obtain a tourist visa.

If it isn't difficult, it isn't worth it.

The children's visitor visa applications will not affect the mother's immigrant visa application.

The mother's immigrant application will affect the children's visitor visa applications because it will be scrutinized as an end run around getting immigrant visas for them.

How old are the children?

They are 18 and 17. But they dont want to emigrate yet. They are in universities that the grandpa is paying for. They want to take advantage of that. As a matter of fact the grandpa wants to pay their trip to Disney. That is why they need a Visa...

So they will have a hard time.. oh great another reason for her family to dislike me....lol

Do they realize that if you petition for them after age 21, it would be 7-8 years for immigrant visas?

Why not get them green cards which takes 6-12 months while they are under age 21 and re-entry permits to attend school in Brazil? That's a better solution if they want to immigrate to the US quickly after age 21.

Age 21 is a significant number.

Furthermore, a foreign degree does not carry much weight with US employers. A US degree is better for life in the US.

Hi Aaron. How would that work?

They can get the GC and still return to go to school? How long are they allowed? I have been trying to talk them into educating here. But if what you say is possible that would be awesome... please point me in the right direction.

Finishing school is a valid reason to be out of the US.

Come with their Mum and then go back to finish up.
