I will file concurrently for my husband, i130 i485 and ead/ap. I'm USC, he's mexican, he is an overstayer; legally entered US. He has 2 daughters in Mexico.

Questions:

On i864, is it 125 or 150% of household?

I read somewhere that says, if daughters aren't going to be in US for more than 6 months, they are not included in the household size. Is that true?

After filing 3 different i130s, and (hopefully) get approved, does that automatically mean the daughters can enter US, or we need to wait for green card?

Are processing times different if it's towards my spouse and the daughters (they will be my step Daughters) does that make a difference processing times wise?

I know I've asked too much questions in VJ, but I want to make sure we have everything perfect, i don't like delays.

9/27/2018 EAD/AP card picked up at post office

Petition for husband has nothing to do with the daughters. You would need to fll separate petitions for each; takes about a year for the entire process (and, yes -- they would count as members of the household when you are petitioning them, but not no on your husband's petition).

It is 125% of poverty line of household size 4, so, about $30k.

2015, I made $32k but 2014 and 2013, i made $18k and $25k respectively. Do i need a co sponsor? Or they will have to go with the latest income which is $32k?

ah -- time and timing.

for the Adjustment of status case - claim you and your husband - that's 2 people. why? you not materially support his kids overseas when filing his case. They aren't countable, yet.

for the 2 I-130s that you will file, there is NO inclusion to count with anything financial, that stuff is pulled in at NVC, later down the road. Evaluate , rather, re-evaluate, then when the NVC wants to see an I-864 for the visa applications.

In general, you need to show prior years income data via tax returns/transcripts, plus current annual income via paystubs/employment letter. Don't get mashed up on 4 people with the husband's submittal, you not counting the 2 kids with his casefile, they are not in the USA and are not countable.
