Hi. I live in New Hampshire (USA) and my wonderful fiancee is from the Philippines but is living and working in Thailand.

She is in process with an annulment in the Philippines and her two kids (both under 16) live with relatives there while she is supporting them from Thailand.

Our plan is to start the K1 process once her annulment is finalized and then get her here where we will marry and get settled before bringing her kids over in a year or two.

Is this possible? Do the kids' visas need to be applied for at the same time as the K1?

I would appreciate any and all advice; I really don't want to mess anything up as we are both looking forward to the "happily ever after" with us and the kids in the US.

Thanks, Lee&Anna; I'm really not looking for advice on the annulment... that is being handled by a lawyer who is a friend of my fiancee's family so no worries there. We have a set (all in) price and it is progressing. It would only be a waste of time if the annulment is not possible which is not the case; I would not be looking for a K1 visa with someone who is not free to marry me.

The advice I'm looking for is the kids following after we're settled in the US.

Totally possible to do as you are planning. The children can get their visas within a year of your fiancee getting her visa as a TO FOLLOW K2, or even later by filing the I-130 (this will add another year to the process roughly). I would do the K2 to follow as it is less expensive and quicker.

Make sure to list the children on the I-129F petition

Lots of Vice-Consuls call this a 'K-2 Follow to Join. '
