So Confused!!! After CR1?

Hey there,


Me (USC) and my husband (UKC) just got his CR1 visa in his passport in the mail today (YAY!)


However, I didn't celebrate for too long because I noticed that his IV expiration date is "May 19, 2016" which makes sense now because his medical exam was November 19, 2015.


Now I know that May 19 is the last possible day for him to enter the US, but the part that we're confused about is the next step - filing for the 10 year 'removal of conditions.'


I'm reading different things on the forums and websites about the 90 day time you have to file, and I still don't get when we're supposed to file the i-751? Is it 90 days of the IV expiration date on his visa, so 90 days before May 19, 2016? Or 90 days, 2 years after he enters the US expiration date (so before May 19, 2018?)


If this makes any difference, our 2 year marriage anniversary is Sept 26, 2016.


Also his work contract ends at the end of March so we were planning to fly back the first week of April...is it cutting it to close to file for his removal of conditions around then? It seems like a lot to prepare...


just slightly stressing out about all this. if anyone can help at all, it'd be greatly appreciated! :confused:

Timeline

He will get a 2 year conditional green card since you have been married less than 2 years upon entry. So the 10 year green card is 2 years down the road. You can submit the paperwork for that 90 days before the green card expires

Or 90 days, 2 years after he enters the US expiration date (so before May 19, 2018?)

It's that - or whatever date he arrives in the USA (so if he shows up tomorrow, it'll be a 90 day window from 2 years from tomorrow). It'll be set as the expiration date on his green card. It's also not 90 days prior as a fixed day - you will file the RoC paperwork at any time in that 90 day window before the expiration date on his green card - not a day later or a day sooner - just any time in that 90 day window before expiration.

You can forget about it for a while - but remember to collect paperwork like joint bank statements and such for the evidence you'll be sending with your RoC paperwork. :)
