My husband and I have been married for 3 months and I have been here in the US for almost a year. We had to get married after my k1 expired because his brother died 2 weeks after I arrived, we both decided to not get married right away because he and his were grieving and I thought it would be disrespectful to go through with the marriage during that period. My husband helped with his brother's hospital dues and the funeral costs, as soon as he was able to recover financially and from the loss we went to the courthouse and got married. We both found out that we can still file for I130, we both wanted to know what type of green card I'm going to get and how long it'll be. Is it 2 years and do I still have to file for ROC after that? TIA

If you get your green card after your 2nd wedding anniversary, then you will get a regular 10 years green card.

If you get your green card before your 2nd anniversary, then you will get a 2 years conditional green card. After 2 years of having that card, you would need to file for ROC.

you are married less than 2 years, so you will get the 2 year GC and file for removal of conditions before the card expires

Thank you for the info...how early can we file for ROC once we get the 2 year green card? My husband wants to know all the details so we can mentally prepare ourselves and not miss any deadlines anymore.

Only married for 3 months, you will get the 2 year conditional green card, you will need to complete ROC in a couple years after being issued your conditional card. Citizenship is possible once you have been an LPR for 3 years.
