Adjusting from Permanent resident to US Citizen

Hello all,

My husband was a DACA and had adjusted to a permanent resident. Now we are excited to begin the process of Applying for US Citizenship. What are the basic forms needed, and a general idea of cost? Any advice? Do you moat do this with lawyers or is it possible to do ourselves?

is that your husband's timeline? did he just get his GC last year?

to qualify for citizenship he must be married for 3 years and been a GC holder for 3 years? did he get a 2 year GC? if so, did he remove conditions?

We were married September of 2014. He received his GC July of 2015. Yes, his GC is for two years. What form do we need to file to remove the conditions? I thought we just waited the two years, then renew it and the conditions would be removed.

he doesn't qualify yet for citizenship,

the purpose of removal of conditions is to prove for a second time that after 2 years, your marriage is still bonafide, a real marriage in order to get the 10 year GC

you can submit the i751 and evidence of bona fide marriage, up to 90 days before the 2 year GC expires

showing proof of co mingling of finances and whatever you have with both names

So we must wait until 90 days before the expiration of his GC to file the i751? Is there anything we can do before that?

you can start gathering evidence,

faxes filing jointly, if you don't have a joint bank account, open one, bills in both of your names, car insurance, health insurance, everything you can in both of your names, pictures once in a while

and the rest, enjoy your life as a couple

aside from collecting evidence, forget about immigration for a while

We already have all of our bills and things in both names and file taxes jointly. We are worried that because his residency is conditional and was gained through DACA that it may be overturned with the upcoming presidential election.

daca has nothing to do now, he no longer has daca, meaning just a work permit

he is a legal permanent resident through marriage to a US Citizen

Even if DACA is no longer an issue, can his PR be taken if a president with a harsh immigration policy is elected? We just want to be very sure he can not be deported or lose his status.

no, it can't be taken away, the president can only stop renewing work permits for those under daca going forward, if there is an approved law, if it comes up to it

he is a GC holder because he is married to you, he no longer holds daca

I was reading the replies before mine and I got confused on why you are worried. How did you husband acquire the Permanent residence? If you are a US Citizen and he got the residence for being married to you, he can apply for citizenship after 3 years. That option required him to be married to you all 3 years. Check if his residence is conditional. You get conditional residence when you adjust status or use a CR1 visa (enter the country with that visa) before the second wedding anniversary. If he adjusted status after the two years, he should have gotten the 10-year permanent residence and he does not have to remove conditions.

If he got the residence not through your marriage, he has to be a resident for 5 years before he can apply for citizenship. Unless he has been married to a USC for at least three years.
