Sorry as this may sound like a stupid question. We are applying for the CR1 visa shortly and i just want to know once my partner shows her ID (shes the american citizen) since we just got married does she have to change her last name in her passport before we can apply? Or can we use her old passport and just attach the marriage certificate? Thank you.

She is not obligated to change her name at all- many woman keep their last name.

Like Penguin said, she is not obligated to change her name at all. However, if she feels the need to honor tradition, which is awesome too, she does not need to change her last name on her passport, so long as when she travels by plane, the ticket reads what is on her passport. Should she choose to want to travel with your surname, then yes, she would need to update her passport or carry your marriage certificate when you travel to avoid confrontation.
