Depends on which visa you are adjusting from. For a K-1 visa, we put the current USCIS status as "K-1" since the K-1 visa expires once it is used and your authorized stay is dependent on the I-94's expiration date, but you can file the AOS anytime. You are only required to get married within 90 days of entry. Now if it is another visa like a F2, tourist or student visa, you need to have an approval notice giving you an immigrant visa number, so are you really out of status?
