Thanks for the very informative post ellis.
1. Where is your case? Are you sure it has been sent back to NVC?

Well I just received the packet today stating they are going to send it back to the NVC. I'm not sure where it is but Mandi has contacted her congresswoman, Joanne emerson I think her name is. They sent her a privacy form to fill out and copies of info that we sent it and other stuff.

Our service center was nebraska but for some reason at the time they had sent it to california to be reviewed.

What do you mean by AR?

I'm the beneficiary but Mandi, the petitioner, has made only 1 visit here. Frankly speaking she didn't have a lot of funds at the time to make another visit. We documented our visit quite a lot.

I'll add some more info here once she finds out where our case is.

Also, confirm this to me but she spoke to a lawyer, and he gave some advice. One of the advice he gave is that he said if nothing works out in this case, then to go to India and stay for 3 months at least, because it's mandatory and it's guaranteed that I would get to go back with Mandi. Now I'm not sure how that exactly works, that might be DCF [Direct Consular Filing] but I'm not sure.

If it is DCF the lawyer was talking about: DCF was suspended worldwide in late January. I don't know what could give you a "guarantee" that you could go back to the States with Mandi after 3 months.

They still do DCF in Delhi. ManuNSam wrote about it but I can't find the post due to the search feature not working at the moment.

Man, I'd be on the horn to my Senators (both of them) and Congressperson (the one from my district) like YESTERDAY. Or even go into their office in person, if at all possible. Find out who the immigration liaison is and ask for a face-to-face with them. Be very nice but persistent.

I always thought the name of the game in this situation was to keep the paperwork at the Consulate. Maybe someone can verify if that's still true...

I do believe the Consulate is required to respond promptly to inquiries from Senators and/or Congresspersons.

So sorry this has happened to you. Best of luck!

Maya

Many thanks to the Visajourney community for all the help!

Well yes, I'm going to have her call again and probably call the other senator and see. I'm going to try to catch them in the embassy if at all possible.

I'm just praying to God now and hoping for the best. This is not in my hands but I wish it was.

Just wanted to update the folks here, I think it has been send back to the NVC and they will send it to the DHS office. Here is what they said in response to the email I sent them:

Dear Ryan:

This is in response to your e-mail regarding your K-1 visa case number ***.

Your fiancé visa application is no longer in our office. Please note that fiancé petitions expire four months from the approval date. The consular officer has the discretion to re-validate fiancé petitions if they expire during processing. However, since the consular officer was not convinced of the relationship in this case, the petition was not revalidated. It was returned to the National Visa Center (NVC) on 6 March 2007. Once NVC receives the petition, it will return it to the approving DHS office. Please direct all future inquiries regarding this case to the approving DHS office that has jurisdiction over your petitioner’s place of residence.

We hope this information is useful to you.

Sincerely,

Consular Section

American Embassy

So I guess if the congressman is going to do anything, it will now have to be at the NVC side of things huh. I just really feel like slapping them. They have no idea what they have put us through.

Hi Ryan,

I dont want to add more stress to your situation, but the very same thing happened to me and my fiance. He went thru Chennai embassy, and we started this journey nearly two years ago. Our case was sent back to the U S in October of 2006 and it has sat without any touches, or anything since then. Yes! Five months just sitting there after being returned. I know very well the bia's and prejudices that the indian embassies are filled with. We gave them four years of proof of our relationship. Stacks and Stacks, and Im convinced that it doesnt matter how much you give them, once they decide something in their head they dont care.

Sadly, My fiance and I split up in December, after over four years. It was a heartbreaking decision, but I couldnt see putting our lives on hold any longer. It seemed no one wanted to help us. My lawyer wouldnt answer my emails. My senator wouldnt answer my letters. It felt so hopeless ! So I let them win. Maybe I was weak, but I did it with the intention of giving my fiance freedom to move on with his life.

It has been really hard for me to deal with and every time I think of the Chennai embassy Im filled with such anger . I hope and pray that some day this immigration process is made much easier for those who are sincere while being able to still weed out the fraud...

Much luck to all.

Wow, I'm real sorry to hear that. I feel for ya. This is not my job to pry into things but I really think you guys should be together. Keep trying. What keeps my faith alive is the fact that I believe in Almighty God and I know for a fact that He can make this happen. You want to talk, you can message me. You can't just let love go that easily. I know this post is about me but you also have to think, you can't let a person you love go that easily. It will tear you apart left and right.

I am also filled with anger from these stupid embassies, because no matter what you do, they have it in their stupid heads that you are a fraud case. Man I really wanted to, I could really screw with them but I just don't want to. I don't want to jeopardize anything. I love her and I want to be with her. :)

I too believe in God's will, and I believe that sometimes his will is not ours. Just loving someone does not always guarantee a happy life together. As I said maybe I just wasnt strong enough to outlast them. But I had become so hopeless just waiting months and months between each step in this crazy process. Our petition was sent back in July.. took it three months to make it back to the states and then as I said has just sat there since October. All together eight months since it was sent back! And besides that we were on AR for eight months before that.

I had heard many "horror" stories about how they will hold it and then send a letter saying its expired and that we have to refile and start all over! I just couldnt deal with it all over again. I have children and grandchildren here in the U S so my going there to live was out of the question. So I saw no other option than to just give in. Even though I will always be sad for losing a great love in my life, I think I did what was right for the two of us.

I wish you much luck in ur endeavor, and pray that you are not in limbo as we were.

Vicki

Surprised to hear all of this. You know, this makes me thing, all this scrutiny and unfairness to us, how can we battle against this? How can we find the officers who are the culprit or put some kind of charge against them? Not saying all visa officers are bad, but man certainly in your and mine case it was. They have no idea how to tell apart a real relationship from a fake one.

I don't know if you get any sort of confirmation that you have withdrawn a petition. Others here would have to advise you on that.

A letter sent by registered mail and the receipt should be ample evidence of a withdrawn petition.

From what I have been told, that's pretty typical for a petition that has been returned due to a lack of bonafides. Just tie it up forever in limbo.

Better to cancel that petition and refile for a different visa type - what I have always heard anyway.

They don't seem to rush that. I withdrew one and it took about 2-3 months before I got a letter from them about it.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
