Hello, me and my wife (USC by birth) filed the I-130 form about a month ago and right now the status of it is still showed as "received" by the USCIS. Since it's located in Nebraska Service Center i know the estimated waiting period is around 5 months. However, we wish to get the other documents ready to save as much time as possible after our case gets forwarded to NVC.

We started filling out the I-864 form, my wife is a full time student right now but has a part time job, therefore we are going to use her parents (either her dad or mom) as a mainly sponsor.

Questions:

Section 5 where it says: "My current individual annual income is:" should we put in the amount she is expecting to make this calendar year (2015) even though it is going to be 2016 by the time our I-130 gets approved?

Section 6 where it says: "My total income as reported on my federal income tax return for the most recent 3 years was:"

Should we put it the amount she made in 2014,2013,2012? or start with 2015 since the approval of our I-130 is supposed to be in 2016?

Since my wife annual income of these years was way below the required IRS poverty line, should I check the box on number 20 ("I was not required to file a federal income tax return as my income was below the IRS required level and I have attached evidence to support this")?

Thanks a lot of answering my questions!! You guys rock!

you cant use the I864EZ if she is not using her own income. there are three questions that MUST be a yes to fill out the ez form. one of those questions for you is a no so you must fill out the A version. and it will be income for 2016 since you wont be sending it in this year. for the years you will start with 2016 then 2015 2014

her parents are going to sign a separate I-864 and submit their own tax return. Plus, she has a job (a part time one). The 1040A allows you to claim credits for any of your dependents you are sponsoring which she does not have any

  1. You only claim credits for child and dependent care expenses, the earned income credit, the credit for the elderly or the disabled, education credits, the child tax credit, the additional child tax credit and the retirement savings contribution credit.

As for the recent 3 years. How can she send her 2016 tax income before the end of the year?? shouldn't it start from 2015?

it will be past april when you finally send off the AOS so for her current total income it will be for 2016 with pay stubs or employee letter to back this claim and her past three years will be 2015 2014 2013 make sense?

sorry I read your titlte wrong I believe I thought you was saying you was filling out the i864ez form but you said 1080ez im not sure what form that is.

lol it's all good.. your previous comment got me kinda confused for a moment. 1040EZ is the briefest version of the regular 1040 form, 1040A stands somewhere in the middle where you can claim tax credits for the defendant you're sponsoring.

Do not fill out this form so early.
