Hello everyone,

I have an approved EAD and Advance Parole and am waiting for my AOS to be approved from a K1 visa following my marriage to a USC.

With the holiday period fast approaching I am looking at travelling home to the UK to spend Christmas with my family.

What are peoples experiences of using AP - I have heard some negative things and am nervous they wont let me back in?

Also I am looking at going for 1 month (mid Dec to mid Jan) - is this too long? Is there a limit on how long you can be out of the country? I would be coming back through Washington DC Dulles airport.

You should be fine. I think the ones more often advised not to use it are ones who overstayed in the US for a long time and then married and filed for AOS. With that history, it is safer to wait on the green card before leaving the country. A month trip does not require any other paperwork.

My wife and I flew to the Philippines this year in March and stayed almost a month (3.5 weeks). They let her back in to the USA on her AP no problem. She only had to go to secondary and answer a few questions upon arrival. I do suggest you bring the following with you though on your trip:

1. Your EAD/AP combo card (of course).

and

2. Your original marriage certificate.

Having both will clear up any conflicts when boarding your flight home, should there be any.
