Hello Community,

I wonder if you could help me with the following questions?

My wife and his father as sponsor are filing the I-864 for me.

1. My wife has worked in the US for the first part of 2015 and then moved overseas to live with me and works here. Can she put her income from the US for her current annual income or because she quit and now has no US income, her current annual income is zero dollars?

2. As for the I-864 from her dad, for his current income is he putting in the amount what his employment letter say or he is putting in what was on his latest tax return from 2014? If the latter, than I am a little bit confused as this is the year of 2015 but he claims current income from a year ago.

3. What lines do you have to use for the current income from

- The IRS tax transcript,

- 1040,

- 1040EZ?

4. If there is no I-864A filed, than the annual income and anual household income are the same?

5. My wife will list her current overseas workplace with zero dollars income. Should she attach a letter that she has income but can not claim it on the I-864 (as they are not from US sources), but will file her tax returns nevertheless?

6. As she has only been here for a few months and will work here only until I get the visa, is her domicile in the US or here? She did get resident permit and quit her US job, but maintained relations to the US.

7. We intend to live for a short amount of time after going back to US at her dad's place. My wife includes me into her household size on her I-864, does her dad have to include either or both of us into his household size on his I-864?

Answers:

  1. She cannot use income from the job she resigned from because the source of said income is no longer there.
  2. The amount on the employer letter, that is what his current income is.
  3. None of the 3 you listed. Use the applicable formula to calculate current income:
    1. If paid hourly wage: wage x number of hours worked each week x 52 = current income
    2. If paid set salary: salary x 12
  4. I'm not 100% sure
  5. Such a letter is unnecessary.
  6. She will need to show how she maintained US domicile.
  7. Her dad will include you in his household size but will not include her.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Thank you so much! Very helpful. Now I only have two questions:

1. My wife's father claimed her as dependent for his most recent tax return, does that mean that he has to include her into his household size? If yes, then my wife is also included on her own I-864, meaning that she is double counted. How to work around that?

2. For the IRS Tax returns for the last 3 years, what lines do you have to use from

- The IRS tax transcript,

- 1040,

- 1040EZ?

Dad files an I-864 and would include his daughter (and any other minor children) and his spouse (if appicable) in his family count.

Your petitioner spouse also files an I-864 with her and you, the intending immigrant, in the family count.

If Dad is married his spouse should complete an I-864a as well. Especially if the file a joint tax return.

If Dad is self employed then line 22 of his most recent tax return is his income. If he is a wage/salary earner then his current income is his annualized income. (for example $100/week x 52 weeks = $5200 annual income)
