Using property overseas for I-864

Hi everyone,

I am living and working abroad. My foreign fiance and me share an apartment, which she owns. If after we get married the apartment then is listed jointly under both of our names is it possible to use the apartment to meet requirenments of affidavit of support? Even if the property is located in a foreign country? I know how much the apartment is worth but I was also wondering what the magic number would be if I wanted to use it? I realize it's a strange question but I am trying to find out some way tio prevent me leaving and going back to America without my wife while the visa is processing simply to satisfy the I-864. I also can't get a joint sponsor because my family doesn't want to joint sponsor, so that's off the table. If anyone has any other ideas to get around me moving back to the USA for a job the filing and waiting almost a year for her visa to process I'm all ears. Also we live in Hungary so DCF isn't possible.

You need to give evidence of a US domicile as well. Any US citizen or green card holder can be a sponsor. Not just family members.

Assets are valued at a 3:1 ratio to income. ($30K assets = $10K income)

Overseas real estate is not likely to be accepted as an asset because it is outside of US jurisdiction so if necessary the sale could not be easily be compelled by the courts. Any real estate would need to be valued by a licensed appraiser.

If foreign assets, including property, is accepted or not depends on the country you're in and what kind of arrangement/treaty they have with the US. Since you're from an EU country, I would think so, but double check with the US embassy in Hungary. The US embassy in Sweden accepts assets in the foreign spouse's name, including property. I have had this confirmed by the US embassy in Sweden and it also says so on their website.

With that said, you still won't know for sure until you're at the interview. As with everything else, it is up to the discretion of the interviewing officer.

And if you're using sole assets to meet the federal poverty guidelines, you need at least $58,000 in assets. But with assets, they tend to want more than just the bare minimum.

Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license
