Hi! I'm a filipino, on a student visa here in Australia and my fiancee just filed a K1 visa petition for me recently. I was just wondering if anyone has had any experience that could guide me through the process? I'm having a dilemma if I should go home to my country (The Philippines) or stay here and extend my visa? Any comments regarding this topic will be appreciated..thanks!:)

On the I-129 form there is a portion thats asked where (us embassy consulate) you will apply for the K1 Visa. What did you wrote there? If an embassy in Australia then your case will be forwarded to Australia after approval. If Manila. your case will be forwarded to Manila.

Take note you still need to get an NBI clearance from Phils and in any other country that you have lived for atleast 6 months.

Then stay in Sydney. You need to follow the Sydney guides, each Consulate may differ on their process of K1.

Get the NBI later, NBI or other police clearance should be at least below 6 months from issuance during the interview.

Thank you, yes approval now are averaging for 2 weeks from NOA1 (CSC). I hope yours will be a smooth approval too.

If you can extend your visa then do the visa process in Australia.

Yes there is a section in the I-129F that asks which embassy, but sadly NVC doesn't look there (Part 2, question 36a & b) when they forward the case file to the appropriate embassy, they look at the physical address listed in Part 2 for ALIEN FIANCEE MAILING ADDRESS, so make sure to list the mailing address where you will be processing the visa application.

Hank,

Being Filipino, would he still not have to return home to do the CFO seminar?

No reason to complete CFO if flying from Australia to the USA. CFO is a Philippine's requirement, not a visa requirement.

I am Romanian but have been living in Japan for quite a while. I have my interview on nov 9 at the consulate in Tokyo, it wasn't an issue.

They just required extra paperwork, documents from my home country.

If you can extend your visa then do the visa process in Australia.
