Please help me to answer correctly to following question :

18.a Have you filed a Federal income tax return for each of the three most recent tax years?

My husband filed taxes only for 2014 and the 2012 and 2013 he was student and didn't have any income to file.

do we have to mark YES or NO to this question?

then there is table for listing income for last 3 years where we entered figure for 2014 and zero for other two years

and it followed by question

20. I was not required to file a Federal income tax return as my income was below IRS required level and i attached evidence to support this

should we check the box?

My husband wrote statement that he was a student and didn't have any income and was not required to file taxes. Is it enough as evidence?

18a - NO

20 - Yes, that is just what he needs to submit. Be sure that he signs the statement.

And ask your husband to write a letter explaining why he did not file taxes for those year and get it notarized and attach with I-864

Thats how I submitted my all these income documents and did not get any objection and got case completed

thank you, yes he did write the letter stating that he was a student in 2nd and 3d year and didn't make any income. However i don't think there is a need to notarize anything since it's written in i864 instruction that they don't need any copies or papers to be certified
